Bank of America agreed to a $500,000 class action lawsuit settlement to resolve claims that it violated Florida law by sending late-night debt-collection communications to account holders.
The Bank of America settlement benefits Florida residents who received communications from Bank of America between 9 p.m. and 8 a.m. in their local time zone regarding their consumer accounts since April 22, 2020.
Plaintiffs in the class action lawsuit claim that Bank of America sent late-night consumer account communications between 9 p.m. and 8 a.m. These communications allegedly violated Florida’s Consumer Collection Practices Act (FCCPA).

Bank of America hasn’t admitted any wrongdoing but agreed to a $500,000 settlement to resolve the FCCPA class action lawsuit.
Under the terms of the Bank of America settlement, class members can receive an equal share of the net settlement fund. Exact payments will vary depending on the number of submitted claims, but class members may receive up to $500 from the settlement.
The deadline for exclusion and objection is Dec. 12, 2023.
The final approval hearing for the Bank of America settlement is scheduled for Jan. 11, 2024.
