A fourth round of payouts is now available as part of a massive $1.2 billion auto parts price-fixing class action settlement.

The settlement benefits consumers who purchased or leased a new vehicle or purchased certain vehicle replacement parts (not directly from the manufacturer) between 1990 and 2019. More information is available in the “Who’s Eligible” section below.

Numerous defendants have agreed to pay into an auto parts price-fixing class action lawsuit settlement to resolve claims that they conspired together to artificially raise the prices of various auto parts. A variety of car brands are included in the settlements including Audi, BMW, Buick, Chevrolet, Dodge, Ford, GMC, Honda, Jeep, Lexus, Mitsubishi, Toyota, and more.

The recent settlements, totaling $184 million, are the fourth round of settlements reached over the auto parts price-fixing class action claims. In total, $1.2 billion in settlement have been reached. Class Members in this fourth round of settlements may also have be eligible for other rounds of settlements.

The fourth round of settlements were reached with the following defendants:

  • Brose SchlieBsysteme GmbH & Co. Kommanditgesellschaft and Brose North America;
  • Corning International Kabushiki Kaisha and Corning Incorporated;
  • Delphi Technologies PLC and Delphi Powertrain Systems LLC;
  • Green Tokai Co. LTD.;
  • Keihin Corporation and Keihin North America, Inc.;
  • KYB Corporation (f/k/a Kayaba Industry Co. Ltd) and KYB Americas Corporation;
  • Maruyasu Industries Co. Ltd. and Curtis Maruyasu America Inc.;
  • Meritor Inc. f/k/a ArvinMeritor Inc.;
  • Mikuni Corporation;
  • Mitsubishi Heavy Industries America Inc. and Mitsubishi Heavy Industries Climate Control Inc.;
  • Panasonic Corporation and Panasonic Corporation of North America;
  • Sanoh Industrial Co. Ltd. and Sanoh America Inc.;
  • Showa Corporation and American Showa Inc.;
  • Reorganized TK Holdings Trust;
  • Tokai Rika Co. Ltd. and TRAM Inc. d/b/a Tokai Rika U.S.A. Inc.;
  • Toyo Denso Co. Ltd. and Weastec Inc.;
  • Toyoda Gosei Co. Ltd., Toyoda Gosei North America Corporation, TG Kentucky LLC, TG Missouri Corp., and TG Fluid Systems USA Corporation

Under the settlement, Class Members are eligible for monetary payments of at least $100. The settlement also provides non-monetary benefits in the form of the defendants agreeing not to engage in any further antitrust law violations.

In order to receive payment under the auto parts price-fixing class action settlement, Class Members need to file a valid Claim Form by Dec. 31, 2019. The deadline for exclusion and objection is Nov. 19, 2019. The final approval hearing for the settlement is scheduled for Dec. 10, 2019.

Who’s Eligible

Consumers who purchased or leased a new vehicle or purchased certain vehicle replacement parts (not directly from the manufacturer) between 1990 and 2019.

A full list of eligible vehicles is available on the settlement website. The list includes a variety of car brands such as Audi, BMW, Buick, Chevrolet, Dodge, Ford, GMC, Honda, Jeep, Lexus, Mitsubishi, Toyota, and more. A variety of other makes and models were eligible for other rounds in the auto parts price-fixing class action settlement.

Depending on the state a Class Member lives in, they may be eligible for monetary or non-monetary benefits. Class Members from Alabama, Alaska, Colorado, Connecticut, Delaware, Georgia, Idaho, Illinois, Indiana, Kentucky, Louisiana, Maryland, New Jersey, Ohio, Oklahoma, Pennsylvania, Texas, Virginia, Wyoming, and Washington are only eligible for non-monetary benefits. Class Members from all other states and the District of Columbia are eligible for monetary benefits as well as non-monetary benefits.

Potential Award

Monetary payments of at least $100. Actual payment amounts will vary depending on the new settlement fund after costs and fees are deducted.

    I heard they are sending out tons of ineligible letters, even to some who had proof. I now realize that the only folks getting rich off these settlements are the lawyers. They deny folks their share in settlements even though many qualify and provide proof. And for some settlements, they ask for receipts from 5-10 years ago. It seems as if enough people would contact the Judge overseeing these settlements they would put pressure on the settlement Administrators to go through a rigorous process to contact and verify eligible claimants. I don’t care what anyone says, there’s no way they are verifying thousands and thousands of claims.

      Cause it happens to be true. Being a legit claim, they don’t specify exactly what they want besides your signature.

    It’s now January 2023. Has payment been made for any of the rounds 1-4 auto parts class action? I remember filing and sending in information when this whole thing started, but haven’t received anything.

    I believe it’s the end of the year, i would have thought we can leave old things behind. who want”s to start the New Year with old things that are dragging into a New Year. that is not a Happy New Year 2023.

    An reply email from the claims administrator today:

    “The Settlements have been approved. However, we are still working to finalize claim determinations for all claims before we can distribute claim determination notices, or funds for eligible claimants. If any additional information or documentation is necessary, we will send you a notice regarding any deficiencies. Otherwise, we expect that payments to class members will be distributed by end of 2022.”

    TL:DR: Money should arrive at the end of the year for Round 4

    Can anyone help? This lawsuit mentions 4th round, did anyone get any sort of payout for 1st, 2nd, 3rd rounds?

      NO I am beginning to think a class action against the class action is needed. I filed for the original, then one ammendment and one for my wife’s cars. I was told by phone that “we have your paperwork and will be processing shortly”. Thjis was in 2020. I have inquired how we can be on classs action four without resolving class action 1,2 and 3. I have sent registered letter asking for an update. NO RESPONSE

    Information from someone inside Garden City Group!
    I understand large fleet operations are weighing in on their options in this case! An appeal must be filed within 30 days after any final approval! That was not the case here. Under what legal premise/instrument are these fleet companies allowed to weigh in under?
    Please advise as GCG has been contacted via certified mail!

    This was the response I received just now asking for a payout update for all four rounds:

    Hello,
    A settlement has been approved by the court and the claims review process is underway. We will reach out to claimants soon if we need any additional information in order to validate their claims. We do not yet have a date for the payment of valid, approved claims, but we anticipate payments will likely start being mailed early next year.

        The Court has still not authorized paying out any claims. Trust us when we say we are as eager as you to see this wrap up.

        There are a few companies that had large rental fleets, that have been discussing what their involvements in this settlement is. Class counsel has been instructed to respond to their queries by 4/25 and they have until 5/7 to reply. This and perhaps other concerns, must of course, delay the finalization of payments. We may know more after these issues are addressed.
