KT tape class action lawsuit

The makers of KT Tape have agreed to pay $1.75 million to resolve allegations that its kinesiology tape was falsely advertised as being able to prevent injuries and provide pain relief.

If you purchased one or more KT Tape products between Oct. 30, 2011 and Nov. 3, 2017, you could get up to 50 percent of the full retail price from this false advertising class action settlement.

Plaintiff Alexander Vuckovic of Massachusetts filed the KT Tape class action lawsuit in 2015 over claims that the athletic tape was deceptively marketed as being able to effectively treat sports-related injuries. According to Vuckovic, every KT Tape package claims to be able to treat 16 different types of injuries including runner’s knee, calf strain, plantar fasciitis, tennis elbow, carpal tunnel and shoulder pain.

However, the plaintiff says the kinesio tape simply doesn’t work as advertised. “KT Health has used deceptive claims regarding the purported benefits of KT tape to charge a premium approximately ten times the price of traditional athletic tape, and has achieved massive sales of KT Tape as a result,” the KT Tape class action states.

The makers of KT Tape are not the only ones facing litigation regarding marketing claims of kinesiology tape. In July 2019, the manufacturer of RockTape faced similar class action allegations that its tape doesn’t provide the advertised pain relief.

Under the terms of the KT Tape settlement, KT Health Holdings Inc. and its subsidiaries will pay $1.75 million to resolve the deceptive marketing allegations. In addition to creating the settlement fund to reimburse customers, KT also agreed to change the way the athletic tape is advertised.

The company will remove the following label claims: “it will keep you pain free,” “prevents injury” and “provides 24-hour pain relief per application.” The kinesiology tape packaging will also include a large, bold disclaimer to inform consumers that the athletic tape is “not clinically proven for all injuries.”

KT Tape consumers who submit a Claim Form no later than May 16, 2018, can get up to 50 percent of the full retail price of the athletic tape. Proof of purchase is not required for the first package of KT Tape being claimed. However, Class Members who are able to submit a receipt along with their Claim Form will be able to claim a total of five KT Tape products from this settlement.

Customers who want to object to or exclude themselves from the terms of this settlement must do so in writing no later than May 16, 2018.

Who’s Eligible

Class Members include all U.S. consumers who purchased one or more packages of KT Tape at any time between Oct. 30, 2011 and Nov. 3, 2017 for personal use and not for resale.

Potential Award

Up to 50 percent of the full retail price of KT Tape products.

Consumers who submit a valid and timely claim will receive up to 50 percent of the price they paid for their KT Tape. For the purpose of this settlement, the “full retail” amounts have been determined for each of the following items:

Proof of Purchase

Not required for the first package of KT Tape. However, Class Members who submit a receipt with their Claim Form are eligible to claim benefits for up to five packages of KT Tape in total.

“For example, if you submit a claim for the purchase of five packages of KT Tape, you will need to submit proof of purchase for four packages, but will not need to submit proof of purchase for the first package.”

    I hope that somehow it gets out there that it does work for some. I have been using for my arthritis in my knees with great results. I am 60 yo and without this tape my vacations would be a painful endeavour. It has been a godsend for me!

      It definitely works for me. I just think a lot of people are not applylg it correctly. I’ve had meniscus surgery and can bowl pain free because of the tape!!
