Pacific Bell/AT&T Landline class action settlement

Details on how to file a claim for the AT&T third-party billing settlement have arrived! If you were billed for third-party charges to your AT&T landline telephone bill between January 1, 2005 and January 14, 2013, you may be eligible to claim a full refund from the class action lawsuit settlement.

The AT&T third-party billing settlement will resolve a 2009 class action lawsuit (Nwabueze v. AT&T Inc.) that accuses AT&T of placing charges from third-party companies on its bills and collecting money for these charges, even though customers had not knowingly authorized the charges.

AT&T denies any wrongdoing, despite eliminating third-party billing on January 1, 2011.

A federal judge granted preliminary approval to the AT&T billing class action settlement in January 2013.

The only way to receive a refund is to submit a valid Claim Form by the deadline of December 2, 2013 or 30 days after you receive a Billing Summary in response to a timely request, whichever is later. You must include either a Billing Summary provided by AT&T as part of this Settlement and identify on that summary any charges you claim were not authorized or provide other supporting documents (e.g., copies of bills with identification of the charges you claim were not authorized).

The case is Nwabueze et al. v. AT&T. et al., Case Number CV-09-1529, in the U.S. District Court for the Northern District of California.

Who’s Eligible

If you were billed for one of these unauthorized third-party charges, you can file a claim to receive a full refund (100%) of these charges. Some Class Members stand to receive hundreds of dollars or more, according to the class counsel. You can request a Billing Summary from AT&T free of charge that will show all third-party charges that appeared on your AT&T landline bill during the Class Period.

UPDATE: Payments for this settlement have been delayed for some Class Members. A viewer has reported to us that she received the following email from the Settlement Administrator on March 28, 2016: “Under the terms of the Settlement Agreement, challenged claims will not be paid until all of the challenges in the challenge and rebuttal process are resolved. Batches of Challenge Notices continue to be mailed on a rolling basis. As such, we are unable to provide you with a specific distribution date at this time. UPDATE: The AT&T landline class action settlement was approved at the Final Fairness Hearing but settlement distribution was delayed by an appeal filed by a single Class Member in December 2013. That appeal was voluntarily dismissed in March 2014, allowing the Settlement Administrator to begin processing claims and payments.

    I just found out about this law suit today, but tomorrow I will be calling and emailing AT&T my self. My phone bill is high and most of the months I am not home. I am a senior citizen and my phone bill is too high.I question them about it,but all I got was that I could change to another program.

    It is now 150 days since I submitted my request for a Billing Summary to AT&T, and I still have not received it.
    This is double the 75 days that AT&T said it would take.
    I just called AT&T, and all they could tell me was that the work to assemble the info was taking longer than expected.
    Does any one have any more info on this?

    I have several different accounts with AT&T and believe there were “Third Party Charges” that I was not aware of paying at the time. I would like more information on this suit.

    AT&T won’t send me mine either…or rather I should say, I have requested multiple times and not received any information back from them. Is there a way to get this or to show you’ve requested a detailed itemization and they have not complied?

    I have submitted all the information including my identity verification, why are they telling me the information didn’t match. Although they mailed all the information mailed back to me.

    never figured out how it got my line phone number
    I have been charged earlier this yr with other peoples
    phone calls.
