A $6.1 million settlement has been reached in a class action lawsuit alleging ANN Inc. misled consumers about the quality and price of merchandise sold at its Ann Taylor Factory and LOFT Outlet stores.
If you purchased items from an Ann Taylor Factory or LOFT Outlet store that was offered at a discount from a regular or original price at any time between May 5, 2012 and May 4, 2016, you may be entitled to benefits from the Ann Taylor class action settlement.
According to the Ann Taylor class action lawsuit, the retailer led consumers to believe outlet merchandise was once sold in retail stores. In reality, the merchandise was actually manufactured exclusively for sale in outlet stores, and the retailer advertised discounts based on fictitious regular prices, the plaintiffs claim.
“In fact, the represented discounts were nothing more than mere phantom markdowns because the represented regular or original prices were artificially inflated and were never the original prices for the merchandise sold at Defendant’s Outlet Stores,” the Ann Taylor class action lawsuit says.
The Ann Taylor class action lawsuit accuses the clothing retailer of violating various federal and state consumer protection and false advertising laws.
Ann Taylor denies the allegations but agreed to settle the fake discount class action lawsuit to avoid the burden and expense of trial.
Class Members who would like to opt out of or object to the Ann Taylor fake discount class action lawsuit must do so no later than March 6, 2018.
UPDATE: On Oct. 15, 2018, Top Class Actions viewers started receiving checks in the mail from the Ann Taylor fake sale class action settlement worth $6.84. Congratulations to everyone who filed a claim and got PAID!
Who’s Eligible
Class Members include “all persons identified in ANN’s business records as of July 25, 2017, who, from May 5, 2012 to May 4, 2016, purchased one or more items from ANN’s Ann Taylor Factory or LOFT Outlet stores offered at a discount from a regular or original price.”
Potential Award
Class Members may make a claim for a cash award worth approximately $5 or a voucher worth approximately $12.
Proof of Purchase
N/A. If you submit a claim for cash, you must provide information about the date and location at which at least one of your qualifying purchases was made.

I have receipts from 2 purchases at Ann Taylor stores. One receipt is dated 11/16/2013 and the other receipt is dated 11/29/2014. I filed my claim on 2-21-18 and have heard nothing.
I filed a claim well in advance of the May deadline, but as of today, Aug 18, 2018. Never received a dime.
