Consumers who purchased AmeriGas or Blue Rhino pre-filled tanks may be eligible to claim up to $125 without proof of purchase as part of a $6.5 million settlement over the amount of propane in the tanks.

Those who are eligible to make a claim in this class action settlement include individuals who bought or exchanged one or more AmeriGas and/or Blue Rhino pre-filled propane tanks between Dec. 1, 2009, and Nov. 30, 2020.

Without proof of purchase, Class Members will be eligible for up to $2.50 per tank for up to 50 tanks, or $125.  Class Members who provide proof of purchase are eligible for up to $5 per tank, with no limit on the number of tanks that can be claimed.

This class action settlement resolves claims that AmeriGas and Blue Rhino allegedly colluded together to lower the amount of propane in their pre-filled propane tanks from 17 pounds to 15 pounds without also reducing the price, resulting in inflated prices for propane customers.

While consumers who purchased either AmeriGas or Blue Rhino propane tanks may be affected by this settlement, it only resolves the claims made against AmeriGas; the Blue Rhino case is continuing in court.

AmeriGas has agreed to end the litigation with this settlement, but AmeriGas does not admit to any wrongdoing. 

The settlement agreement established two Classes.

The Indirect Purchaser Settlement Class is made up of those who purchased AmeriGas or Blue Rhino propane tanks, other than a wholesale purchase directly from AmeriGas or Blue Rhino for resale, in Arizona, California, Iowa, Maine, Michigan, Minnesota, Nevada, New Mexico, North Carolina, North Dakota, South Dakota, Utah or West Virginia during the Class Period.

The Direct Purchaser Settlement Class is made up of consumers nationwide who purchased one of the propane tanks directly from AmeriGas or Blue Rhino via a vending machine at retailers or other locations, or paid one of the companies directly through a vending machine to exchange a previously purchased propane tank, other than a wholesale purchase intended for resale.

A fairness hearing is scheduled for March 31, 2021.

The deadline for filing a Claim Form, opting out or objecting to the settlement is March 8, 2021.

Who’s Eligible

Potential Award
  • With proof of purchase, Class Members will be eligible to claim a cash payment of $5 for each tank purchased. There is no limit to the number of tanks that may be claimed with proof of purchase.
  • Without proof of purchase, Class Members may claim $2.50 for each tank, up to 50 propane tanks, for a maximum of $125.
Proof of Purchase

Valid forms of proof of purchase include store receipts, credit card receipts, UPC codes from propane tank labels and store records. Consumers with something else they think confirms the purchase should submit it along with their Claim Form. The Claims Administrator will determine whether the proof is sufficient.

    Why are they telling people to check the spam email if they sitting right there with your claim information pulled up I’m sure their system shows if a payment has been sent or not to whoever they are talking to

    I called this morning. they told me check my spam folder. there was nothing. then they told me they’d escalate it and get back to me in 5 days as to why my payment never arrived. I eagerly await their call lol

      Same here. August 2, 2021… and I have not received any e-mail with the electronic payment for my valid claim (they had previously sent me an e-mail saying my claim was valid and I should expect payment “sometime in the beginning of July”).

      What gives?

      I HAVE BEEN HAVING A DISCUSSION WITH THEIR SENIOR CLAIMS ADMINISTRATOR AND THE ONLY OPTIONS FOR DIGITAL PAYMENTS DIGITAL MASTER CARD, TARGET GIFT CERTIFICATE OR AN AMAZON GIFT CERTIFICATE.

      I REQUESTED PAY PAL THEY ARE NOT DOING PAYPAL.

      nobody else did. still waiting in florida for my $93.26 is what the rep said I was getting

      I have been told by Plaintiffs’ class attorney that they would be sending out the digital payments on July 8, 2021 that the payments will be made within two weeks.

      Still nothing.

      I am going to send a e Mail to staff attorney that if I do not receive my payment by Aug 5, 2021, I will be file with the District Court via the Court’s CM/ECF system to obtain a Court order for payment as I have a Pacer Account and I already have a CM/ECF.

          I received the same e-mail stating they are looking into it after I had sent the claim administrator my valid claim number and message a couple days ago.

          The claim administrator should really fix its electronic payments issue.

    Include your original email that has the claim reference # and lets see if we can get someone to take this seriously! Let them know that the claims administration company that they placed in charge of distributing the funds did a SHIT job and we want our payment as the court ordered and instructed them to do!
