Consumers who purchased AmeriGas or Blue Rhino pre-filled tanks may be eligible to claim up to $125 without proof of purchase as part of a $6.5 million settlement over the amount of propane in the tanks.

Those who are eligible to make a claim in this class action settlement include individuals who bought or exchanged one or more AmeriGas and/or Blue Rhino pre-filled propane tanks between Dec. 1, 2009, and Nov. 30, 2020.

Without proof of purchase, Class Members will be eligible for up to $2.50 per tank for up to 50 tanks, or $125.  Class Members who provide proof of purchase are eligible for up to $5 per tank, with no limit on the number of tanks that can be claimed.

This class action settlement resolves claims that AmeriGas and Blue Rhino allegedly colluded together to lower the amount of propane in their pre-filled propane tanks from 17 pounds to 15 pounds without also reducing the price, resulting in inflated prices for propane customers.

While consumers who purchased either AmeriGas or Blue Rhino propane tanks may be affected by this settlement, it only resolves the claims made against AmeriGas; the Blue Rhino case is continuing in court.

AmeriGas has agreed to end the litigation with this settlement, but AmeriGas does not admit to any wrongdoing. 

The settlement agreement established two Classes.

The Indirect Purchaser Settlement Class is made up of those who purchased AmeriGas or Blue Rhino propane tanks, other than a wholesale purchase directly from AmeriGas or Blue Rhino for resale, in Arizona, California, Iowa, Maine, Michigan, Minnesota, Nevada, New Mexico, North Carolina, North Dakota, South Dakota, Utah or West Virginia during the Class Period.

The Direct Purchaser Settlement Class is made up of consumers nationwide who purchased one of the propane tanks directly from AmeriGas or Blue Rhino via a vending machine at retailers or other locations, or paid one of the companies directly through a vending machine to exchange a previously purchased propane tank, other than a wholesale purchase intended for resale.

A fairness hearing is scheduled for March 31, 2021.

The deadline for filing a Claim Form, opting out or objecting to the settlement is March 8, 2021.

Who’s Eligible

Potential Award
  • With proof of purchase, Class Members will be eligible to claim a cash payment of $5 for each tank purchased. There is no limit to the number of tanks that may be claimed with proof of purchase.
  • Without proof of purchase, Class Members may claim $2.50 for each tank, up to 50 propane tanks, for a maximum of $125.
Proof of Purchase

Valid forms of proof of purchase include store receipts, credit card receipts, UPC codes from propane tank labels and store records. Consumers with something else they think confirms the purchase should submit it along with their Claim Form. The Claims Administrator will determine whether the proof is sufficient.

      i got the first email saying i was approved and expect a second email in july. i called and they told me the amount was $241 and i should expect the email before the end of july. haven’t gotten the email yet but i hope today

    To everybody that is complaining, like I know everyone uses propane, a bunch! Its America for crying out load, of course we burn scheize, just chill yall. Take solace in the fact that these corporations are even held responsible for their “outta pocket” lame a$$ practices. Don’t know if you’ve noticed, but our own deranged govt is becoming eer more comfortable, the tighter their boot is on our necks. You must not sweat the small stuff, and it’s all small stuff. (Except the govt’s current boot therapy) So let’s all just wait for these helpful individuals and give them space to be able to do their jobs, then we will get our shillings, or 2 bits or whatever it is and we can spend it on something that was literally cheaper the day before. I for one am gonna blow it all on more shorted propane tanks, and just live my life and try to be ever mindful of the needs of others. God bless the 2md ammendment??

    I’m gonna get screwed. Now they cannot find a claim on me. They can pull up my name but they claim that they cannot find my claim form. I know I filled one out! I’m so freaking mad.

      PayPal is a choice, I just called them & they told me I was approved fr $241.65 & can expect an email with the payment option I selected in the next cpl days & I asked him if PayPal was a choice, he said yes.. so I don’t know why people are saying PayPal isn’t a choice, we should get in next 2 days hopefully, that’s what they’re telling us

    I just received my email for the digital payment, the options are Mastercard, Amazon, and Target (I went with Amazon). It appears that payments are $4.83 per valid tank claimed based off of the 19 tanks that I claimed, $91.77 total received. The timing matches what I was told last week by the Administrator (emails being sent throughout the week).

        Tonya, there was no option listed on the claim form for PayPal. It just noted that you could select “Digital Payment.”

        You receive a link to retrieve the gift card code. From that link, you can either select to apply it to your account or can copy the code and apply it through Amazon.

    I called and was told I was approved, but they were still working on an amount. I want 241.65 like the people with checks got. I claimed 50. I could have claimed more but 50 was max. I live in Louisiana we boil seafood almost every weekend bbq’s. We go thru some tanks!

    Just got off the phone with one of there agents. She says my payment is pending but I’m approved for $77.32. What’s that about I claimed 50. I think there dogging us

      that’s b.s. sum1 else wrote that they were told $115 for digital payment & he only claimed 24!! I would dispute that.. I am going to if I get screwed!! I knew they were gonna do this when they sent out checks 1st for almost twice what they were supposed to get.. they 4got about digital payment & gave our share as extra to checks.. wtf!!!

      I called this morning as well. he said I am approved for $241 and as everyone else has said it should be by the end of July. he was very obviously reading from a script. I don’t understand why they even bothered to send me the email THREE weeks ago telling me I was approved and would be getting a settlement soon why not just send the payment? lol

      For sure we got screwed. I claimed 25 tanks. For what I was approved for doesn’t even cover the price I paid for 1 semi filled tank!!! This is BS!!!
