A $10.5 million class action settlement has been reached, ending claims that Allstate placed unwanted telemarketing calls in violation of the Telephone Consumer Protection Act.
If you received a telemarketing call from Oh Insurance Agency on behalf of Allstate between April 19, 2013 and Feb. 21, 2017, you could get up to $120 from this class action settlement.
A plumbing company brought the class action lawsuit against Oh Insurance Agency and Allstate after allegedly receiving “nuisance” telemarketing calls through a third party, SalesDialers.
According to the Allstate class action, the companies contacted unwitting consumers in violation of a federal law — the Telephone Consumer Protection Act.
The Act, also known as the TCPA, prohibits a variety of telemarketing practices, including calling consumers with a marketing message without their prior, express consent. Additionally, the TCPA restricts the use of automatic dialing systems and prerecorded messages, often called “robocalling.”
The Allstate telemarketing calls class action lawsuit alleged that Oh Insurance Agency made unwanted calls to thousands of consumers. Further, the company used an automatic dialing system and left prerecorded messages.
The marketing messages promoted Allstate’s insurance services, said the plaintiffs, implicating the nationwide insurance company in the class action.
Oh Insurance and Allstate deny any wrongdoing, but have agreed to pay $10.5 million to exit the class action lawsuit.
According to the settlement website, 53,743 cell phone numbers received Allstate telemarketing calls. Most Class Members will receive a postcard notifying them of the settlement; however, some addresses may not be known.
Class Members who received a postcard do not need to do anything to receive a payment from the settlement. Class Members who have not received a postcard notifying them of the Allstate telemarketing class action settlement must submit a Claim Form online or by mail. Claim Forms must contain the cell phone number that received the telemarketing call.
Class Members who wish to opt out of or object to the Allstate telemarketing class action settlement must do so by Oct. 15, 2019.

Class Members include those who received an Allstate telemarketing call from Oh Insurance Agency using SalesDialers dialing system between April 19, 2013 and Feb. 21, 2017.
