A $28 million settlement has been reached which will resolve allegations that Alarm.com placed telemarketing calls to cell phones without obtaining prior express consent.
Class Members include consumers who received calls on behalf of or from Alarm.com since Dec. 30, 2011. Specifically, to be eligible Class Members must have either received these calls:
- On their cell phone and the call must have been made with an automatic dialing system or used an artificial prerecorded voice; or
- On a residential line using an artificial prerecorded voice; or
- Two or more calls received on a phone number that was included on the National Do Not Call Registry.
Lead plaintiffs accused the alarm service company, as well as a third party advertiser, Alliance, of making telemarketing calls in violation of the Telephone Consumer Protection Act.
The TCPA alarm class action lawsuit alleged that more than 1.2 million consumers were contacted in this way.
The Telephone Consumer Protection Act, or TCPA, prohibits companies like Alarm.com and Alliance from using telemarketing calls without obtaining the prior express permission of consumers. The law, enacted by Congress in the 1990s, also restricts the use of automatic dialing systems and prerecorded messages.
The TCPA also created the National Do Not Call Registry which allows consumers to list their cell and landline numbers. Phone numbers on this list cannot be contacted by telemarketers. Indeed, companies that violate the TCPA can face steep fines of up to $1,500 per call they make in violation of the law.
Alarm.com agreed to pay $28 million to settle the TCPA alarm class action lawsuit. In addition, the company says it will change how it advertises to ensure compliance with the TCPA.
The estimated payout for Class Members in the TCPA alarm class action settlement is between $94 and $142 depending on how many valid claims are submitted. Claim Forms can be submitted online or by mail.
Class Members must either provide a Claim ID number or the phone number(s) that received a call from either Alarm.com or Alliance.
Those who suspect they may have been one of the 1.2 million contacted by Alarm.com or Alliance can check their phone number(s) on the settlement website to see if they are eligible for the Alarm.com TCPA class action settlement.
Class Members who wish to exclude themselves or object to the TCPA alarm class action settlement must do so by April 16, 2019.
Who’s Eligible
Class Members include those who “received a telemarketing call promoting Alarm.com’s goods or services from Alliance or third parties hired by Alliance:
(1) On a cellular telephone using an automatic telephone dialing system or artificial or pre-recorded voice; or
(2) On a residential telephone using an artificial or pre-recorded voice; or
(3) Two or more times within a twelve-month period on a cellular or residential telephone number that was on the National Do-Not-Call Registry.”
Calls must have been received on or after Dec. 30, 2011.
Potential Award
$94 to $142 depending on the number of valid claims submitted.

how do you know it’s legit? i have never had to give a SS#
We called the Administrator . It’s totally legit. Anytime you have winnings or any type of income (including a survey from a survey group) that totals over $600 you must file a W9.
what # are you guys calling to actually talking with someone?
I claimed 3 phone calls, wondering what the settlement amount is per call since some people are receiving letters to file their social security number. I have not gotten a letter yet.
I too have something in the mail today, not sure what it is.
I just received the same letter today November 18, 2019. It was mailed on November 14th. It is actually legit and i have had to do this before when I and an aunt received a $2400 settlement. The IRS considers this income because it is over $600. It is also the same claims administrator as listed on the website.
I received the same letter but I’m confused about feeling it out I don’t know and I don’t have a pin number cuz you tell me how you feel it out please?

Thanks. That means if you claimed three phone numbers, then the max award is $1,500. Makes sense why they’re asking for an IRS Form W-9. Anything $600 and above is taxable.
I suppose they’ll have to issue checks in the amount of $599.99. It’s the only legal way to pay the defendants.
Besides, if you decide to submit a W-9, the IRS will want a good portion of your settlement anyhow.
I’d rather take the reduction.

The Settlement was approved on August 14, 2019. The Settlement Administrator is contacting those class members who are to receive settlement checks of $600 or more to obtain an executed IRS Form W-9. Class members can view the Order authorizing the administrator to obtain this information under the Case Documents tab of this website.
They sent a claim form to me asking for my ss number stating that is was goinv to over $600.00 and they had to report it. Iz this legit$

Received the letter today. I am confused because it’s understanding that the amount should not be overall a3 $600.
I got the same letter and the reason why is $600 is the IRS set limit for unreported winnings, payment, or other income.
Anytime you win, work, settle, or get over $600 you must file with the IRS. It is clearly stated in this settlement in Exhibit 3:

How do I go about filling it out I don’t know nothing about a tin number?

I received the same letter. On the letter it wrote “Failure to submit a valid substitute form W-9 by deadline (12/14/19) may result in reduction of your payment”. I guess you have an option not to submit your W-9 (SS number) except you will receive less settlement amount. I am taking the risk and I filed with my SS number. I will need to make sure I filed with IRS as part of earnings. Good luck for all who filed for this claim.

You will receive 599 if you were to receive over 600 if you don’t fill out the form.
I didn’t give them a social security number and if they made it less without a requirement that makes them in violation of title 15 USC 1692 sections a-v

Is there any updates to this settlement, as the agreement reads payments will go out to valid class members no later than 30 days after the effective date which was Aug 15. I had 22 calls so Im wondering how much are are payments…There is no email for the administrator. No one answers the general one, I tried already. Is anything on Pacer beyond their website? I received a postcard saying that I was included in his lawsuit, however when I was filling it out I could not remember my phone number from 2011, I’ve had so many different ones I called the number on the card and spoke to a gentleman who told me to leave it blank that if they sent me the card that they knew my number well i got a notice saying i can’t bye included without the number, tried to call again numerous times for weeks and not one return call!

Follow the link on their official page. It worked for me. If anyone on here doesn’t want to have to claim the $$ as income, I suggest you let them send you a reduced amount which will likely be right under $600
