A $28 million settlement has been reached which will resolve allegations that Alarm.com placed telemarketing calls to cell phones without obtaining prior express consent.

Class Members include consumers who received calls on behalf of or from Alarm.com since Dec. 30, 2011. Specifically, to be eligible Class Members must have either received these calls:

  • On their cell phone and the call must have been made with an automatic dialing system or used an artificial prerecorded voice; or
  • On a residential line using an artificial prerecorded voice; or
  • Two or more calls received on a phone number that was included on the National Do Not Call Registry.

Lead plaintiffs accused the alarm service company, as well as a third party advertiser, Alliance, of making telemarketing calls in violation of the Telephone Consumer Protection Act.

The TCPA alarm class action lawsuit alleged that more than 1.2 million consumers were contacted in this way.

The Telephone Consumer Protection Act, or TCPA, prohibits companies like Alarm.com and Alliance from using telemarketing calls without obtaining the prior express permission of consumers. The law, enacted by Congress in the 1990s, also restricts the use of automatic dialing systems and prerecorded messages.

The TCPA also created the National Do Not Call Registry which allows consumers to list their cell and landline numbers. Phone numbers on this list cannot be contacted by telemarketers. Indeed, companies that violate the TCPA can face steep fines of up to $1,500 per call they make in violation of the law.

Alarm.com agreed to pay $28 million to settle the TCPA alarm class action lawsuit. In addition, the company says it will change how it advertises to ensure compliance with the TCPA.

The estimated payout for Class Members in the TCPA alarm class action settlement is between $94 and $142 depending on how many valid claims are submitted. Claim Forms can be submitted online or by mail.

Class Members must either provide a Claim ID number or the phone number(s) that received a call from either Alarm.com or Alliance.

Those who suspect they may have been one of the 1.2 million contacted by Alarm.com or Alliance can check their phone number(s) on the settlement website to see if they are eligible for the Alarm.com TCPA class action settlement.

Class Members who wish to exclude themselves or object to the TCPA alarm class action settlement must do so by April 16, 2019.

Who’s Eligible

Class Members include those who “received a telemarketing call promoting Alarm.com’s goods or services from Alliance or third parties hired by Alliance:

(1) On a cellular telephone using an automatic telephone dialing system or artificial or pre-recorded voice; or

(2) On a residential telephone using an artificial or pre-recorded voice; or

(3) Two or more times within a twelve-month period on a cellular or residential telephone number that was on the National Do-Not-Call Registry.”

Calls must have been received on or after Dec. 30, 2011.

Potential Award

$94 to $142 depending on the number of valid claims submitted.

    Has anyone else ever seen a settlement for this much more than originally anticipated/estimated? Seems like if anything, it’s usually a lot LESS than original estimate. Just wondering if this happens a lot.

      Yes, there has been plenty of times where the settlement checks are larger due to the fact that not alot of people filed. The more people that file for a settlement the less money is distributed.
