Cavalry Portfolio Services TCPA Settlement Payout
Top Class Actions readers are reporting they’ve received a settlement payout of $60.95 in the Cavalry Portfolio Services class action lawsuit.
The debt collector agreed to pay more than $24 million to resolve claims it violated the Telephone Consumer Protection Act (TCPA) by calling consumers without prior consent.
Cavalry agreed to create a Cash Fund of up to $6,150,00 in addition to a Debt Relief Fund of up to $18 million to compensate Class Members.
Consumers filing the class action argued their rights were violated because the law prohibits businesses from placing solicitation calls to people’s cellphones without consent. Cavalry allegedly made the debt collection calls using the Aspect Ensemble Pro or Avaya Proactive Contact 5.0 system between Feb. 8, 2009 and Jan. 16, 2016.

Target Debit Card Fees Settlement Payout
A settlement payout of $3.93 in the Target debit card fees class action lawsuit has reached some TCA readers.
The retailer agreed to an $8.2 million settlement resolving claims it deceptively marketed its debit cards.
A Target debit card settlement of $8.2 million will settle claims that the retail giant deceptively marketed its store debit cards.
According to plaintiffs in two class action lawsuits, Target misrepresents its debit card terms to encourage customers to sign up and buy things they otherwise wouldn’t have.
The class action lawsuits alleged Target advertises the card as a traditional debit card that will be declined if sufficient funds are not in the account. They argued debit cards do not charge insufficient funds fees if the transaction doesn’t go through, whereas Target debit card holders are subject to such fees.

Target Corp., Case No. 3:16-cv-01678, in the U.S. District Court for the Southern District of California and Michelle Dixon, et al. v. Target Corp., Case No. 0:18-cv-02660, in the U.S. District Court for the District of Minnesota.
Missouri Massage Envy Class Action Settlement Checks In the Mail
Massage Envy customers in Missouri have begun receiving $7 settlement payout checks.
The company agreed to a $1.6 million settlement in a class action lawsuit that claimed it did not provide customers with their full booked massage time.
The plaintiffs filed their complaint in April 2019, claiming they and other consumers who booked massages at Massage Envy didn’t get the full benefits of introductory and non-member offers.
Though the spa advertises massages of varying length options for new customers or non-members, those massages don’t last as long as advertised.
According to the plaintiffs, the massages last only 50, 80, or 110 minutes rather than one hour, one and a half hours, and two hours, respectively. Allegedly, 10 minutes of the appointment time is supposed to be for consultation and dressing time, but that is not disclosed to consumers.

The Massage Envy Class Action Lawsuit is Mark Pirozzi, et al. v. Massage Envy Franchising LLC, Case No. 4:19-cv-00807, in the U.S. District Court for the Eastern District of Missouri.
Fastenal Credit Card Receipt Settlement Checks In the Mail
Class Members in the Fastenal credit card receipt class action lawsuit should keep their eyes on the mailbox — one TCA reader has reported receiving a settlement payout of $760!
Fastenal agreed to pay $1.3 million to settle claims the company prints credit card receipts that violate federal law.
According to the class action lawsuit, Fastenal receipts reveal too much information about customers’ payment carts, including more than the last five digits of the card number and expiration date information.
The receipts allegedly violated the Fair and Accurate Credit Transactions Act (FACTA), which regulates how much information can appear on electronically printed receipts as a means of protecting consumers from fraud and identity theft.
