DeWalt, Black+Decker miter saw defect class action lawsuit overview:
- Who: David Lane and Lorraine Anda filed a class action lawsuit against DeWalt Industrial Tool Co. and Stanley Black+Decker Inc.
- Why: Lane and Anda claim DeWalt and Black+Decker sold 12-inch Sliding Compound Miter Saws with a dangerous defect that the companies delayed disclosing to consumers.

DeWalt Industrial Tool Co. and Stanley Black+Decker Inc. sold 12-inch Sliding Compound Miter Saws containing a dangerous design defect that causes their rear safety guards to potentially break or detach, a new class action lawsuit alleges.
Plaintiffs David Lane and Lorraine Anda claim the alleged defect renders the DeWALT miter saws “unsuitable for their principal and intended purpose.”
Lane and Anda argue that a subsequent recall initiated by DeWalt and Black+Decker is “grossly inadequate” since it does not provide consumers with direct notice or any monetary relief.
Further, DeWalt and Black+Decker did not disclose the defect to consumers until after it had received at least nine separate reports of lacerations injuries occurring as a direct result of the defect.
DeWalt, Black+Decker accused of profiting ‘enormously’ by allegedly delaying disclosure of defect
“With over a million units sold at approximately $600 each, Defendants profited enormously from its failure to disclose the Product Defect sooner,” the DeWalt class action states.
Lane and Anda want to represent a nationwide class and California subclass of consumers who purchased the DeWalt 12-inch Sliding Compound Miter Saws without an intention to resell them.
DeWalt and Black+Decker are accused of fraud by omission and unjust enrichment and of violating California’s Consumers Legal Remedies Act and Unfair Competition Law, along with the Magnuson-Moss Warranty Act, among other things.
The plaintiffs demand a jury trial and request declaratory and injunctive relief along with an award of compensatory and punitive damages for themselves and all class members.
