Why Haven’t I Received My Settlement Check Yet?

If you filed a claim for a class action settlement, there are many possible reasons why you have not received a check yet. Most commonly, the reason that you have not received a settlement check is because the settlement agreement has not become final and effective.

A judge must hear arguments about why the proposed class action settlement should be approved at the Final Fairness Hearing (you can find out when the Final Fairness Hearing is scheduled on the settlement notice or website). Funds will not be distributed to claimants until the judge grants final approval to the settlement and approves the method for disbursement. Once this order is submitted to the court, the class action settlement has become “effective.”

If Class Members were required to submit Claim Forms, each claim must be reviewed and approved. In some cases, the Settlement Administrator may request more information from claimants before approving their claim. Depending on the case, this approval process may be completed relatively quickly, or it may take several months to resolve. Typically, the Settlement Administrator won’t issue payments until all submitted claims have been reviewed. [NOTE: Top Class Actions is not a Settlement Administrator. Even if a judge grants final approval to a class action settlement, it still may be subject to appeal. If an appeals court decides to hear the case, it may take quite a while for the class action lawsuit to be resolved. In some cases, appeals can cause settlement payments to be delayed by years—or cause the settlement to be overturned.

Why Have Others Received Their Settlement Check, But I Haven’t?

It can be unnerving to find out that other claimants have received settlement checks when you’re still waiting for yours. There are several reasons why checks for the same settlement go out at different times. If a settlement has an option to submit a Claim Form without proof of purchase, a Settlement Administrator may mail out these payments first while they review the documentation submitted by other claimants. Typically, claimants who submit documentation will be entitled to more compensation than those who do not, so the Settlement Administrator will take extra time to verify those claims.

Some class action settlements also involve several subclasses. The Settlement Administrator may decide to send payment to each subclass at different times, most likely based on the amount of compensation at stake or the amount of documentation the subclass members were required to submit.

If the Settlement Administrator has indicated a certain date by which the checks would be mailed, wait a couple of weeks before you get concerned. Mail service can differ widely from region to region. Some people may receive their checks immediately while other checks may be delayed due to slow mail service. If you still haven’t received your check, you may contact the Settlement Administrator for more information.

Why Did My Settlement Check Bounce?

Unfortunately, sometimes settlement checks bounce, leaving consumers stuck paying a bank fee. There are a few reasons why a settlement check may bounce. The settlement money may not have been transferred to the Settlement Administrator’s account at the time you cashed your check, or there may have been some other error that prevented the funds from being available.

If you have problems cashing your settlement check, contact the Settlement Administrator to let them know. They should be able to tell you what the problem is and whether it is safe for you to try to cash the check again. They may also offer to send you a replacement check.

    Lynwood Strip Search Settlement, Hi Inquiring about this settlement in which I was apart of. Had received my first check in January of 2022. The letter stated I would receive 2 more checks. 1 in 2023 and the other in 2024 at the same time each year. Still waiting on this years. Keep checking there website for updates and they just keep changing the date. Legally how long can they keep doing this. This is getting ridiculous. Please help

      I filled out my claim form years ago and we have moved several times but the mail always follows me and that took some long ass time to get all that paperwork and receipts turned in and I too did not receive any information or a check

        Tell your attorney about it. If he or she won’t help, then obtain the proper grievance form and fill it out, make copies, ..submit to: 1) Wa bar association..2) also within the system 3 you can always file some sort of tortclaim

        1. My own reply to what I said above . File first a grievance on your firm which is representing you. And you can or should be able to file an appeal in response to their answer to your grievance..if I don't like the reply...then there might be a says:

    I have been a member of the Round up class action lawsuit since it began. I am estimating almost 7 years. I contacted the Johnson Law firm located in Texas. My settlement amount went from 103,000 to 63,000 to 35,000 to 16,000 and now I haven’t heard from the law firm except to inform me of the numerous reasons to keep pushing any distributions back for 3months, then 6 months, then 6 months again. Then to be paid out in January of this year. So far, I have not heard a peep from these people. What is the problem? I feel like they are a scam and wonder if there is a way to put a class action lawsuit against them?

      All of us should file a grievance to the BAR against the attorney’s in the firm. I can’t get my phone calls returned, nor my emails. I have asked for the emails of the attorney so I can respond to them, and that has been ignored too.

        My husband received one check two years ago. We were told another check would be issued the next year. Now they say hold is waiting for release from medical insurance companies. It’s been almost three years of this! I feel like they have stolen my money. It is a different firm than previously stated. I’m afraid to name ours for fear of retri.

    Had a claim with samsung top load washer and received only 1 piece of mail. It had been settled in December of 2021 with no notices. Now I can’t get the administrator to answer questions I have. I know you are not lawyers but seems way to many issues with settlements. Y can’t the courts do anything to the administrators

      I filed a claim for the Superior, Wi Husky refinery explosion and I needed to move a couple of times. I was in the middle of trying to get the company to send my payment to the correct address and I never did receive the check. They wouldn’t even bother to reply to my emails on the subject and because of that, it was mailed to the wrong address apparently. I don’t know for sure because like I said, I never received a check. In the middle of trying to communicate with these people, I received a message telling me it was now too late because the final day had passed!! I am so angry about all this and feel it was intentional! When I confronted them about the lack of communication their response was, we were not obligated to notify anyone!! How absolutely ridiculous!! Shame on these people. 😡🤬

    I’m on the Facebook biometric suit and no one will cash my check, first it was my ID expired, then my online bank rejected it and now it’s written all up on the back and the administratior won’t send it another way or replace the check idk what to do I need the money help!!!

    I was on the Huge casino class. It was finalized feb 11 2021. I wrote the settlement administrator and asked when will we be paid and they answered back “i do not know”. What the heck is that kind of answer? Are they for real? Like professional people handling it? Do they have credentials?

      Apparently they are going through the claims and removing fraudulent ones, some where filed filed from other countries, or outside of Washington state, etc.

      I agree that the Administrator is not helpful or informative. This was supposed to be paid out within 60 days of the date it was final. It doesn’t look like this will happen.

      I have not even got a response from the claims administrator for the BigFish Class Action. My first E-Mail to them was in November 2020. I was contacted by Edelson PC a couple of times but I sent them an Email and January with follow-up Emails with NO response. Seems a bit unorganized which makes me nervous.

      Good question!! I filed a claim for the Superior, Wi Husky refinery explosion and had been trying to get them to communicate with me about the address. Because of their lack of communication, my check was “apparently “ sent to the wrong address a couple of times. In the middle of all that, they finally just said the final date had passed and they were not obligated to “notify “ anyone!! Pathetic jerks if you ask me! They just didn’t want to bother I guess.
