Why Haven’t I Received My Settlement Check Yet?

If you filed a claim for a class action settlement, there are many possible reasons why you have not received a check yet. Most commonly, the reason that you have not received a settlement check is because the settlement agreement has not become final and effective.

A judge must hear arguments about why the proposed class action settlement should be approved at the Final Fairness Hearing (you can find out when the Final Fairness Hearing is scheduled on the settlement notice or website). Funds will not be distributed to claimants until the judge grants final approval to the settlement and approves the method for disbursement. Once this order is submitted to the court, the class action settlement has become “effective.”

If Class Members were required to submit Claim Forms, each claim must be reviewed and approved. In some cases, the Settlement Administrator may request more information from claimants before approving their claim. Depending on the case, this approval process may be completed relatively quickly, or it may take several months to resolve. Typically, the Settlement Administrator won’t issue payments until all submitted claims have been reviewed. [NOTE: Top Class Actions is not a Settlement Administrator. Even if a judge grants final approval to a class action settlement, it still may be subject to appeal. If an appeals court decides to hear the case, it may take quite a while for the class action lawsuit to be resolved. In some cases, appeals can cause settlement payments to be delayed by years—or cause the settlement to be overturned.

Why Have Others Received Their Settlement Check, But I Haven’t?

It can be unnerving to find out that other claimants have received settlement checks when you’re still waiting for yours. There are several reasons why checks for the same settlement go out at different times. If a settlement has an option to submit a Claim Form without proof of purchase, a Settlement Administrator may mail out these payments first while they review the documentation submitted by other claimants. Typically, claimants who submit documentation will be entitled to more compensation than those who do not, so the Settlement Administrator will take extra time to verify those claims.

Some class action settlements also involve several subclasses. The Settlement Administrator may decide to send payment to each subclass at different times, most likely based on the amount of compensation at stake or the amount of documentation the subclass members were required to submit.

If the Settlement Administrator has indicated a certain date by which the checks would be mailed, wait a couple of weeks before you get concerned. Mail service can differ widely from region to region. Some people may receive their checks immediately while other checks may be delayed due to slow mail service. If you still haven’t received your check, you may contact the Settlement Administrator for more information.

Why Did My Settlement Check Bounce?

Unfortunately, sometimes settlement checks bounce, leaving consumers stuck paying a bank fee. There are a few reasons why a settlement check may bounce. The settlement money may not have been transferred to the Settlement Administrator’s account at the time you cashed your check, or there may have been some other error that prevented the funds from being available.

If you have problems cashing your settlement check, contact the Settlement Administrator to let them know. They should be able to tell you what the problem is and whether it is safe for you to try to cash the check again. They may also offer to send you a replacement check.

    I had a lawyer do 4 car accidents Law suite for me and he didn’t pay me . He owes me over $72,000 dollars but he said it all went on bills.But I showed him proof that those bills went on collection agency and my credit report. Then he said that he had to Medicare and Medicaid but I didn’t have to use neither. I paid for everything with cash. Can y’all help me file a lawsuit against him. The final hearing took place on 12/5/16. The court docket has not yet been updated with the judge’s signed final approval of the settlement. The settlement website has been updated with this information as well. Claims will not be paid until after the court grants the settlement final approval. Once that happens, there is then a 30 day period in which appeals can be filed. There has not been any information released on the number of claims filed and the amount per claim to be paid. If you have any questions about your particular claim, you can contact the settlement administrator or class counsel with your questions. Please keep checking Top Class Actions for updates. We will let our viewers know as soon as the settlement is granted final approval by the court!

      In general, Settlement Administrators run all claimants names and addresses through the USPS Change of Address database before mailing out checks. That means that as long as the USPS is aware of your move you SHOULD be in good shape, but, it’s always best to check with the Settlement Administrator to make sure. We recommend sending your change of address information to the settlement administrator for any claims you’ve filed. We offer contact information for the claims administrator for every class action settlement reported on our site. The claims administrator handles the entire claims process.

    I’m waiting on my united recovery settlement, the tresseme settlement and the western union settlement. Haven’t heard nothing. Some were updated but still no official date on payment. Please help

      No word on when United Recovery will pay out. As of the end of August, almost 18,000 claims had been submitted. So, it’s very likely that the settlement administrator is still working to review and process claims.

      Appeals have been filed to the TRESemme settlement. Claims will not be paid until all appeals are resolved.

      The judge has not yet granted final approval to the Western Union TCPA settlement. Claims will not be paid until after the judge grants the settlement final approval.

    I bought a house through country wide in 2004 an it was for closed on how come i was never notified. About a settlement i moved to southern Oregon an i just found out thete was a settlement an i wasnt notifed is there any thing i can do to get my settlement i lost my job my house an my family because of that morgue i would hope that i would beable to my settlement if not who do i sue countrywide or the attorney grenrel. Couse its not like that couldnt find me they found me serve forcloser pappers

    I filed for some settlements several years ago. What is the best to way to go about checking to see whether they were ever paid out or not ? I keep a large binder of my paid, and pending settlements so I can keep track of them. I am trying to “clean-out” the front/oldest section of the binder. But I do not want anything to go missed either. Thank you for your help.
