Nordstrom failed to make its website fully accessible to and independently usable by individuals who are blind or visually impaired, a new class action lawsuit alleges.
Plaintiff Samaya Hussein claims Nordstrom’s website contains access barriers that prevent it from being compatible with screen-reading software used by individuals who are blind or visually impaired to browse the internet.
Hussein argues Nordstrom is denying individuals who are blind and visually impaired with full and equal access to the goods and services offered on its website, in an alleged violation of the Americans with Disabilities Act (ADA).
“Because Defendant’s website, www.nordstrom.com … is not equally accessible to blind and visually impaired consumers, it violates the ADA,” the Nordstrom class action states.
Hussein wants to represent a nationwide class of individuals who are legally blind and who were denied access to the equal enjoyment of goods and services offered on Nordstrom’s website.
Nordstrom website contains broken links, missing alt-text, other access barriers, says class action
Access barriers to screen-reading software found on Nordstrom’s website include broken links, missing alt-text, hidden elements on web pages, incorrectly formatted lists, and unannounced pop ups, among other things, the Nordstrom class action alleges.
“The law requires that the Defendant reasonably accommodate Plaintiff’s disabilities by removing these existing access barriers,” the Nordstrom class action states.
Hussein argues Nordstrom has both failed and refused to move the alleged access barriers from its website, meaning individuals who are blind or visually impaired “are still being denied’ equal access to it.
“If the Website were equally accessible to all, Plaintiff could independently navigate the Website and complete a desired transaction as sighted individuals do,” the Nordstrom class action states.
Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of nominal damages for herself and all class members.
The Department of Justice proposed new rules last month aimed at ensuring government websites are fully accessible and compliant with ADA regulations.
