Online sports merchandise retailer Fanatics failed to make its Dallas Cowboys website fully accessible to and individually usable by individuals who are blind and or visually impaired, a new class action lawsuit alleges.
Plaintiff Felix Castro claims Fanatics’ website selling Dallas Cowboys-themed merch contains access barriers preventing it from being fully compatible with screen-reading software used to browse the internet by individuals who are blind or visually impaired.
Castro, a blind man, argues Fanatics is denying individuals who are blind or visually impaired with equal access to the goods and services it provides to its non-disabled customers on its Dallas Cowboys website.
“Shop.dallascowboys.com contains significant access barriers that make it difficult if not impossible for blind and visually-impaired customers to use the website,” the Fanatics class action states.
Castro wants to represent a nationwide class and New York subclass of legally blind individuals who were denied access to the enjoyment of goods and services offered on Fanatics’ Dallas Cowboys website.
Blind or visually impaired persons cannot complete transaction on Fanatics’ Dallas Cowboys website, says class action
Castro argues access barriers on Fanatics’ Dallas Cowboys website makes it impossible for individuals who are blind or visually impaired to “even complete a transaction.”
“Fanatics excludes the blind and visually-impaired from the full and equal participation in the growing Internet economy that is increasingly a fundamental part of the common marketplace and daily living,” the Fanatics class action states.
Access barriers on Fanatics’ Dallas Cowboys website include inaccessible drop-down menus, ambiguous link texts, an inaccurate heading hierarchy, and inaccessible contact info, among other things, the Fanatics class action alleges.
Castro claims Fanatics is in violation of the Americans with Disabilities Act, New York State Human Rights Law, and New York State Civil Rights Law.
Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of compensatory and statutory damages for himself and all class members.
A separate class action lawsuit was filed against Fanatics — along with Major League Baseball (MLB) and its 32 franchises — last year over claims it worked with MLB to restrict competition for MLB-licensed products sold in third-party online marketplaces.
