Dollar General website class action overview:

Dollar General violated the law by making one of its websites inaccessible to Americans who are blind or visually impaired, a new class action lawsuit alleges.

Plaintiff Mary Conner filed the class action lawsuit against Dollar General Corporation and Dolgencorp LLC on July 10 in a North Carolina federal court, alleging violations of the Americans With Disabilities Act (ADA). 

Conner is a visually-impaired and legally blind person who requires screen-reading software to read website content using her computer, the lawsuit states.

According to the lawsuit, Dollar General failed to design, construct, maintain, and operate its website popshelf.com to be fully accessible to and independently usable by blind or visually-impaired people.

Popshelf.com is a website that provides a wide array of the goods, services, price specials, employment opportunities and other programs offered by Dollar General to the public, the lawsuit states.

“Defendants are denying blind and visually-impaired persons throughout the United States with equal access to the goods and services Dollar General provides to their non-disabled customers through [the website],” it says.

‘Thousands’ of barriers to access, lawsuit alleges

Popshelf.com contains thousands of access barriers that make it difficult if not impossible for blind and visually-impaired customers to use the website, Conner alleges.

“In fact, the access barriers make it impossible for blind and visually-impaired users to even complete a transaction on the website,” she says.

As a result, Dollar General effectively excludes blind and visually-impaired Americans from full and equal participation in the growing Internet economy that is increasingly a fundamental part of daily living, the lawsuit states.

Conner is suing on behalf of a national class of consumers who are blind or visually impaired and who tried to access the website. Conner seeks certification of the class action, damages, fees, costs, a judgment forcing Dollar General to make its website accessible, and a jury trial.

Meanwhile, Dollar General has been hit with a class action lawsuit alleging it falsely markets its Honey Graham Crackers as being predominantly made with whole grains and honey, when the ingredient list shows the main ingredients are enriched flour and sugar.
