NFL disability benefits class action lawsuit overview:

Administrators for the National Football League’s Player Disability & Survivor Benefit Plan and NFL Player Disability & Neurocognitive Benefit Plan breached their fiduciary duty of loyalty to plan members, a new class action lawsuit alleges.
A group of former NFL players argue plan administrators had a willful, systematic pattern of hostile and adversarial positions, affirmative misrepresentations, active concealment, and bad faith.
The former players argue the NFL plan administrators ultimately failed to “discharge their duties solely and exclusively in the interest of disabled retired NFL Players and their beneficiaries.”
“Plaintiffs seek to pull back the curtain on behalf of all similarly situated former NFL Players, bringing many relevant factual and legal issues concerning the Plan to light,” the NFL class action states.
The group of former NFL players want to represent a class of individuals who filed an application for one or more categories of disability benefits under the plan since Aug. 1, 1970, along with several subclasses.
NFL plan administrators repeatedly lied, committed ‘flagrant’ violations, says class action
The NFL plan administrators repeatedly lied, made material misrepresentations, and committed “flagrant” violations of the Employee Retirement Income Security Act (ERISA), the NFL class action alleges.
“Reliance on conflicted advisors have resulted in a pattern of systematic bias against disabled NFL Players— motivated by financial considerations to limit the payment of benefits to the very Players whom the Plan was designed to help,” the NFL class action states.
The group of former NFL players are demanding a jury trial and requesting injunctive and declaratory relief along with an award of monetary compensation for themselves and all class members.
The NFL — along with other professional sports leagues — has been involved in a number of complaints recently, including one filed against the league and the Los Angeles Chargers over claims they bore responsibility for a player’s season-ending knee injury.
