Moleskine website class action overview:

Papermaker Moleskine does not make its website accessible to blind and visually impaired people using a screen reader, in violation of the law, a new class action lawsuit alleges.

Plaintiff Miriam Cruz filed the class action lawsuit against Moleskine America Inc. on Feb. 27 in a New York federal court alleging violations of the Americans With Disabilities Act (ADA). 

Cruz is a visually impaired and legally blind person who requires screen-reading software to read website content using her computer. 

According to her lawsuit, Moleskine—the company behind the famous black-leather bound notebooks—failed to design, construct, maintain and operate its website, www.moleskine.com, to be fully accessible to and independently usable by her and other blind and visually impaired people.

“Moleskine.com contains significant access barriers that make it difficult if not impossible for blind and visually impaired customers to use the website,” the Moleskine class action alleges. 

‘In fact, the access barriers make it impossible for blind and visually-impaired users to enjoy and learn about the services at Moleskine.com prior to entering Defendant’s physical location.” 

Moleskine website contains multiple access barriers, lawsuit alleges

Moleskine.com contains multiple pervasive access barriers, the lawsuit alleges.

The barriers include inaccurate landmark structure, inadequate focus order, changing of content without advance warning, inaccurate alt-text on graphics, inaccessible drop-down menus, inaccurate navigation links, redundant links where adjacent links go to the same URL address, and the requirement that transactions be performed solely with a mouse, according to the Moleskine class action.

“Consequently, blind customers are essentially prevented from the ability to enjoy and use Defendant’s Moleskine.com,” Cruz alleges.

Cruz sued on behalf of all legally blind people in the United States who tried to use Moleskine.com and could not. 

She’s seeking an injunction forcing the company to make its website accessible, certification of the class, damages, fees, costs and a jury trial.

Meanwhile, SoulCycle has reached a settlement to end claims it failed to design and construct its website to make it fully accessible and independently usable for individuals who are blind or visually impaired.
