House of Lashes failed to make its website fully accessible to and independently usable by individuals who are blind or visually impaired, a new class action lawsuit alleges. 

Plaintiff Jasmine Toro, who is legally blind, claims House of Lashes’s website contains access barriers to screen-reading software used by individuals who are blind or visually impaired to access the internet. 

Toro argues House of Lashes is denying individuals who are blind or visually impaired with the equal access to the goods and services the company provides to non-disabled customers on its website. 

“House of Lashes denies the blind access to goods, services and information made available through Houseoflashes.com by preventing them from freely navigating Houseoflashes.com,” the House of Lashes class action states. 

Toro wants to represent a nationwide class and New York subclass of individuals who are legally blind and who attempted to access House of Lashes’ website and were subsequently denied equal access to the goods and services it offers.

House of Lashes’ website contains multiple access barriers to screen-reading software, including inaccurate landmark structures and alt-text on graphics, and inaccurate navigation links, among other things, the House of Lashes class action alleges. 

“Houseoflashes.com contains significant access barriers that make it difficult if not impossible for blind and visually-impaired customers to use the website,” the House of Lashes class action states. 

Toro claims House of Lashes is violating the Americans with Disabilities Act, New York City Human Rights Law, New York State Human Rights Law, and New York State Civil Rights Law

Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of compensatory and statutory damages for herself and all class members. 

A similar class action lawsuit was filed against Moleskine in March by a consumer arguing the papermaker failed to make its website fully accessible to and independently usable by individuals who are blind or visually impaired.
