Glamorise Foundations has failed to make its website fully accessible to and independently usable by individuals who are blind or visually impaired, a new class action lawsuit alleges.
Plaintiff Janelys Hernandez claims Glamorise denies equal access to the goods and services offered on its website to individuals who are blind or visually impaired.
Hernandez argues Glamorise’s website, meanwhile, contains access barriers that make it “difficult if not impossible” for individuals who are blind or visually impaired to even make a transaction on it.
“Glamorise Foundations excludes the blind and visually-impaired from the full and equal participation in the growing Internet economy that is increasingly a fundamental part of the common marketplace and daily living,” the Glamorise class action states.
Hernandez wants to represent a nationwide class and New York subclass of all legally blind individuals who have attempted to access Glamorise’s website and subsequently been denied access to the goods and services it offered.
Glamorise website contains ‘numerous access barriers’ to screen-reading software, says class action
Glamorise’s website contains “numerous” access barriers to screen-reading software used by individuals who are blind or visually impaired to browse the internet, the Glamorise class action alleges.
Hernandez claims Glamorise’s website contains access barriers including inaccurate alt-text on graphics, inaccurate drop-down menus, and unclear labels for interactive elements, among other things.
“Glamorise Foundations has inaccessible design that deprives the Plaintiff and blind customers of the opportunity to make purchases on Glamorise.com on their own,” the Glamorise class action states.
Hernandez claims Glamorise is in violation of the Americans with Disabilities Act, New York State Human Rights Law, New York State Civil Rights Law, and New York City Human Rights Law.
Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of compensatory and statutory damages for herself and all class members.
A similar class action lawsuit was filed against Bealls last month by a consumer arguing the retail corporation failed to make its website fully accessible to individuals who are blind or visually impaired.
