A.I. Root website class action lawsuit overview: 

  • Who: Seana Cromitie filed a class action lawsuit against The A.I. Root Company. 
  • Why: Cromitie claims A.I. Root failed to make its website fully accessible and independently usable to individuals who are blind or visually impaired.
  • Where: The class action lawsuit was filed in New York federal court.

The A.I. Root Company failed to make its website fully accessible and independently usable for individuals who are blind or visually impaired, a new class action lawsuit alleges. 

Plaintiff Seana Cromitie claims the website for A.I. Root — which produces and sells candles — contains access barriers that prevent individuals who are blind or visually impaired from being able to use screen-reading software to browse it. 

Cromitie, who is blind, argues A.I. Root is denying full and equal access to its website to individuals who are blind or visually impaired, and thus allegedly denying them the goods and services offered on it as well. 

“Plaintiff has been denied the full use and enjoyment of the facilities, goods and services offered to the general public,” the A.I. Root class action states. 

Cromitie wants to represent a nationwide class and New York City subclass of legally blind individuals who have attempted to access A.I. Root’s website and been denied access to the equal enjoyment of goods and services offered on it. 

A.I. Root website contains access barriers to screen-reading software, says class action 

A.I. Root’s website contains a number of access barriers to screen-reading software, including broken links, missing label elements or title attributes, and a lack of alt text, among other things, the A.I. Root class action alleges. 

“Plaintiff was denied a shopping experience similar to that of a sighted individual due to the website’s lack of a variety of features and accommodations,” the A.I. Root class action states. 

Cromitie claims that, due to the alleged access barriers, she was “effectively barred” from “being able to determine what specific products were offered for sale.” 

A.I. Root is accused of violating the Americans with Disabilities Act and New York City Human Rights Law

Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of compensatory, statutory, and punitive damages for herself and all class members. 

A similar class action lawsuit was filed against papermaker Moleskine earlier this month by a consumer arguing the company failed to make its website fully accessible to individuals who are blind and visually impaired.
