President Donald Trump’s campaign has filed a lawsuit after state authorities took action to make sure Nevada voters could participate in the 2020 election despite the coronavirus pandemic.

According to the president’s reelection campaign, Nevada Gov. Steve Sisolak’s new law is unlawful and impractical. However, some argue that the Trump lawsuit is nonsensical and fails to pass legal muster.

Sisolak signed AB4 into law this week in order to allow Nevada voters to receive a ballot in the mail automatically if they are registered voters. Additional benefits are provided by the law, including requirements that a minimum number of in-person polling places must be provided for both early voting and day of voting for the 2020 election.

After hearing of the new law for Nevada voters, Trump took to Twitter to express his displeasure, CBS News reported. According to Trump, Sisolak is “using Covid to steal the state.”

“In an illegal late night coup, Nevada’s clubhouse Governor made it impossible for Republicans to win the state,” the president tweeted. “See you in Court!”

Before Sisolak signed the law, Trump had threatened to sue the state if it signed the bill into law. Now, the president has followed through on his threats in a lawsuit against Nevada Secretary of State Barbara Cegavske.

According to the lawsuit filed by the Trump campaign, the GOP and other Republican groups, the new state law is unconstitutional and will make it easier for voter fraud to run rampant in the election.

However, Cegavske reportedly testified at a recent state assembly that the June primary elections – which were conducted primarily via mail – did not have a single instance of voter fraud.

Additionally, the lawsuit takes issue with two of the primary provisions of the Nevada voters law: the allowance for late-arriving ballots to be counted and the requirement for a higher minimum number of polling stations in high-population counties.

The Republican National Committee (RNC) notes that many changes are major and, with the 2020 election quickly approaching, the party will have to divert significant resources and money to educate Nevada voters about the changes.

“Many of AB4’s provisions are head-scratching — particularly given the stark irregularities in Nevada’s June 2020 primary election, and because AB4 changes so many election laws so close to the 2020 general election,” the presidential lawsuit alleges.

Although the president claims the AB4 law is unlawful, Vox contends his lawsuit may be motivated by Trump’s personal interests.

According to an Emerson College poll, Biden supporters prefer to vote by mail while Trump supporters prefer to vote in-person.

Specifically, the poll says that 76% of those who prefer to vote by mail plan to vote for Biden, while 65% of those who prefer to vote in-person plan to vote for Trump. By blocking Nevada voters from casting their vote through the mail, Trump may succeed in chipping away his opponent’s voting base.

Regardless of the president’s motivations, Trump’s lawsuit reportedly suffers from several flaws and may not pass legal muster.

For example, Trump rings several claims relying upon federal laws and regulations. However, these statutes likely cannot be enforced when a lawsuit is brought forth by a private party such as the Trump campaign.

Nevada leadership has responded to the lawsuit, calling it a “sham” and criticizing Trump’s lack of leadership ahead of the 2020 election.

“As states fill the void of Trump’s leadership and begin to step up to the challenge of protecting both voters’ health and their constitutional right to vote, Trump and Republicans are throwing a fit. That is because Trump does not want to hear from the people, he knows what they will say,” Nevada State Democratic Party chairman William McCurdy said in a statement, according to CNN.

Several other states have plans to transition their voters to mail-in ballots for the November 2020 election. Hawaii, Colorado, Oregon, Utah, Washington, Vermont, California and the District of Columbia all join Nevada in the switch to mail-in ballots.

    Those mail in ballots can be signed by any person that gets his or her hands on it. My mail in ballot if misplaced can be opened and whomever has it can vote any way they want.

      One’s signature is on file. There has been study after study regarding mail in ballots and there is no fraud. The dictator in the white house has voted by mail in ballot in FL. His press secretary illegally voted in FL using her parents address. she has a family and lives in Washington D.C. This is a bunch of nonsense to disenfranchise Democrats from voting

    Voting is a responsibility of all citizens to cast their saying in an election. Whether you vote by mail or in-person gives that person an opportunity to voice their opinion. There are citizens who cannot vote in person and they must be recognized. I truly look at both sizes of voting, however, I would never slam a citizen for using either method.

      Seniors or those w/disabilities have used absentee ballots (same as mail in ballot) for years. what’s the problem?

    I live in Pa were so far we still have a choice of voting. However, we have received from our county a letter and 3 application per envelope to fill out and send back. They were torn up and filed in the trash can. The GOP just sent us 3 flyer in the mail telling us that we have not registered to do mail in ballot yet and we need to do so. They even went as far as putting in red bold letters make America great again. Because of that slogan i thought it was from the President but after reading and looking closely i found it was from the GOP. In order to vote by mail you must send in a copy of your driver’s license. Now your information is out their. That creates a problem right their. Anyone with your information now can use it and open accounts in your name. I feel this way if everyone can shot at walmart, Lowe’s and home depot were covid19 does not seem to exist then you can go to the polls and vote. Yes you must wear a mask in all these places so why can’t you wear a mask to vote as well. The Democrat know this is the only way they can win the elections. It is my right as a citizen of the United States of America to get out and go to the polls and vote. That is what i will do on election day. No one and not even the governor of any state has the right to take that away from you.

    Mail in ballots should never have been allowed in the first place. The United States Post Office isn’t responsible for running the elections. Nor do they hold themselves accountable for “random” or “accidental” damage to items placed in the mail. This is just another democrat scheme to bring in millions of non-US resident voters to overwhelm legitimate voters they don’t agree with. What’s next, vote by email or vote by text message? Yeah, I can just see it now. A family filled with 10-20 minors all voting Democrat like mom and dad told them to do on their cell phones at the same time. Selfie time!

    Also, the person that wrote this article should be ashamed of themselves for writing such an obvious partisan hit piece.

      I live in Oregon. We have done vote-by-mail since I was 18. Never had any issues with the process. anyone stating that voting by mail somehow induces voter fraud is LYING. Your signature is on file with the election office, and you must sign your ballot. Also, pretending that somehow voting by mail favor the democratic party is just ludicrous. How does voting by mail favor any one group of people over another?? Answer: it doesn’t. There is absolutely nothing wrong with the vote by mail system.

    I do not live in Nevada or any of the States that want to follow through. I live in a state that I can still vote in person. I am more comfortable with that system because I feel my vote will definitely be counted. I do not trust the random mailings as what is being proposed, and will fight it if the state I live in attempts to do so. However, I do not believe we will have to worry about it.

    As a Nevada Resident I would like the right to choose the way I cast my vote. I choose to do it in person because I don’t trust our system. Why cannot they meet in the middle and mail the ballot and then you have to go to a polling station to show ID and drop it off in a ballot box? Just a thought

      I agree with you. You have the right to vote the way you want. The only way you will keep that right is to file a lawsuit against your state.
