Lawsuit challenges Wisconsin election results.

President Donald Trump has filed a new lawsuit in Wisconsin, naming election officials and challenging the state’s election results.

According to the complaint, reportedly filed a day after Trump’s first lawsuit was lodged over Wisconsin’s election results, election officials allowed widespread violations of the election code, making the process more vulnerable to fraud. The lawsuit targets alleged widespread absentee voting that took place and infractions.

“At the heart of each violation of the Wisconsin Election Code described in this Complaint was the purposeful disregard of thoughtful legislative safeguards meant to prevent absentee ballot fraud and to promote uniform treatment of absentee ballots throughout the State,” asserts the complaint filed in Wisconsin federal court.

The lawsuit claims that Wisconsin election officials contradicted state law when it made mail-in voting more available to its citizens. Specifically, the president claims that officials disregarded state law limits on mail-in voting, allowed unmanned voting drop boxes, and processed votes without poll watcher observation.

In addition, the lawsuit alleges that voters were permitted to mail-in ballots that did not meet requirements under state law, specifically voter certifications.

Further, Trump claims that poll workers were allowed to engage in “ballot tampering.”

According to the complaint, ballot tampering is “a practice forbidden by state law wherein election workers alter the certification of the voter or witness on mail-in ballots which, contrary to the Wisconsin Election Code, was expressly authorized by the Wisconsin Elections Commission, resulting in disparate and unequal application of the voting laws throughout Wisconsin and opening the door to standardless and subjective determinations of election workers which undermined uniform treatment of absentee ballots throughout the State.”

According to ABC News, no evidence of voter fraud in Wisconsin has been proffered by the president or his lawyers. Wisconsin, along with other states, reportedly expanded mail-in and absentee voting options for citizens to attempt to stymie the spread of the coronavirus pandemic. The president’s lawsuit argues that the ongoing spread of COVID-19 is not an excuse to skirt election laws.

Trump is seeking a court order declaring that Wisconsin election officials “tainted” more than 50,000 ballots, pointing out that this is “a number well in excess of the current estimated difference between the vote totals for the Republican and Democrat candidates for President.” The lawsuit says the court should order the election result to be turned over to the Wisconsin state legislature – currently run by Republicans.

“By ignoring the Wisconsin Legislature’s express directions regarding the collection, handling, processing, canvassing, and counting of absentee ballots and related activities and/or through improper certification of elections and related activities, all in violation of the Wisconsin Election Code and through violations of the Electors and Elections Clauses and the Equal Protection and Due Process Clauses to the United States Constitution, the Defendants ran an unconstitutional and unlawful Presidential election in Wisconsin,” concludes the lawsuit.

The lawsuit points out that the Electoral College is scheduled to cast its votes on Dec. 14, 2020.

A speedy review of Trump’s complaint is necessary, says the lawsuit, to ensure all parties can make it through the appeals process by Dec. 11.

Though the lawsuit is taking a different tactic than others filed by the campaign, asking the court to invalidate votes because of the risk of fraud, rather than allegations of outright voter fraud, an expert told ABC that the lawsuit is unlikely to be successful.

“Under Wisconsin law, and under federal law, Biden won the most votes in the state of Wisconsin and he’s entitled to — and is going to get — the 10 electoral votes from the state of Wisconsin,” a nonpartisan, nonprofit attorney told reporters. “And that’s what the law provides for pretty clearly. And there’s not an avenue around that.”

ABC reports that Democrats have not responded to the new lawsuit yet, although a lead attorney defending against other Trump lawsuits reportedly called the filings “frivolous lawsuits” on social media and accused Trump and his lawyers of “clogging the courts and misleading the public.”

Reportedly, Democratic candidate Joe Biden garnered 20,000 more votes in the state than Trump. The Trump campaign reportedly paid $3 million for a recount that increased Biden’s lead by 87.

Wisconsin Public Radio reports that, in a separate lawsuit filed a day earlier, Trump asked the Wisconsin Supreme Court to invalidate more than 220,000 votes from Dane and Milwaukee counties. According to the first lawsuit, votes from these heavily Democratic counties were cast without meeting state requirements.
