Enterprise Leasing Company—West LLC and Vanguard Car Rental USA LLC have asked a Nevada federal judge to preliminarily approve a class action settlement over allegations they improperly charged “airport concession recovery fees” to consumers who rented cars from Enterprise, Alamo and National rental car locations at Nevada airports.
On Nov. 4, the plaintiffs filed a motion for preliminary approval of the Nevada airport fee class action settlement. On Tuesday, Enterprise and Vanguard submitted a memorandum asking the judge to approve the class action settlement. Vanguard rents cars under the National and Alamo brands.
“In joining Plaintiffs’ motion Enterprise and Vanguard emphasize that the factual and legal issues in this case were and are vigorously disputed and contested by the parties, and that the proposed settlement reflects a negotiated resolution of the claims asserted by the Plaintiffs,” Enterprise and Vanguard wrote, emphasizing that they agree with the plaintiffs that the class action settlement is “fundamentally fair, adequate and reasonable.”
The Nevada airport fee class action lawsuit alleged that Enterprise and Vanguard violated Nevada law that purportedly prohibits the practice of separately stating and charging an airport concession recovery fee to customers who are renting cars.
According to the court filing, airports charge “airport concession fees” to ground transportation operators. These fees are in addition to any rent the operator already pays. Allegedly, car rental companies such as Enterprise, National and Alamo often pass these fees onto consumers by charging them “airport concession recovery fees.”
Enterprise and Vanguard deny any wrongdoing and insist they consistently provided customers with “complete, accurate information regarding the total rental rate, including all estimated taxes, fees and surcharges,” according to the court filing.
Under the terms of the proposed airport concession recovery fee class action settlement, Class Members would be eligible to receive either a check for 80 percent of the amount paid in airport concession recovery fees or one or more vouchers for a free day’s car rental from Enterprise, National or Alamo. All Class Members will be eligible to receive at least one voucher, regardless of how much they paid in airport concession recovery fees during the Class Period. The vouchers can be used throughout the United States and will not be restricted to car rentals at the Nevada airport locations.
Enterprise and Vanguard emphasize that the potential benefits from the Nevada airport concession recovery fee class action settlement “represent at least a substantial portion of the actual amounts paid by class members for airport concession recovery fees, and in some cases far more than the actual amounts paid.”
