Anthem Blue Cross PPO Plan Class Action Settlement
By Matt O’Donnell
The proposed Anthem Blue Cross class action settlement will resolve a lawsuit, titled Feller, et al. v. Anthem Blue Cross of California, etc., et al., that alleged Anthem Blue Cross closed the PPO Share 500, PPO Share 1000, PPO Share 1500, and PPO Share 2500 individual Anthem Blue Cross health plans without providing policyholders the options or notices required by California law. The class action lawsuit seeks an order enjoining Anthem Blue Cross from engaging in any conduct that violates such laws and providing consumers appropriate relief placing them where they were before these blocks were closed, as well as attorneys’ fees and reimbursement of legal expenses.
You’re considered a Class Member of the Anthem Blue Cross PPO class action lawsuit settlement if you are a current California resident and were enrolled in the PPO Share 500, PPO Share 1000, PPO Share 1500, and PPO Share 2500 individual Anthem Blue Cross Health Plans [the “Closed Block Plans”] and you were sent a notice of closure in or about September 2009, and continue to maintain your health insurance coverage through Anthem Blue Cross whether in a Closed Block Plan or in another individual health plan offered by Anthem Blue Cross as of the date of the Agreement.
As a Class Member, you can several benefits under the Anthem Blue Cross class action settlement, including the ability move without medical underwriting to another of the four closed plans, provided the movement is to a closed plan with a higher deductible. There are numerous other benefits available to you, which are all outlined in the Class Action Settlement Notice.
You do not need to do anything to participate in the Anthem Blue Cross settlement; you will only need to read and respond to the notices you will receive about the right to change health care plans and relevant pricing information. However, if you wish to opt out of the settlement and retain your individual rights to sue, you must submit your Exclusion Request no later than August 18, 2011.
