An unpaid overtime class action lawsuit was recently filed in federal court by the employees of a Texas Cable Company.
The wage and hour class action lawsuit alleges that the company violated the Fair Labor Standards Act by refusing to pay overtime wages and withholding payment for standard hours worked.
Plaintiff Anthony W. along with a group of co-workers have been working at the Georgia offices of Intec Communications LLC for the at least last three years.
According to the Intec Communications overtime class action lawsuit, the cable company has refused to pay their workers overtime compensation even though its employees have been working more than 40 hours per week.
Anthony and the other plaintiffs allege that Intec Communications forced its workers to arrive early and work without pay, and that the company punished and reprimanded employees who were late or did not comply with the company work policies.
Intec Communications also allegedly did not pay its workers for the time they spent driving to and each of their various job sites. Anthony alleges that the company knew the requirements of the workers’ jobs required work before and after visits to work sites but Intec Communications refused to provide proper compensation.
The early morning work hours at the company warehouse were spent returning equipment from the prior day, updating inventory, collecting equipment, completing paperwork, and receiving new assignments for the day.
The wage and overtime lawsuit also claims that Intec failed to maintain a clock in and clock out system that tracked their employees hours.
Finally the lawsuit asserts that the defendants deducted certain operating costs from their workers hourly pay (when equipment broke or went missing), causing their hourly pay rates to fall below the established federal minimum wage during the time in question.
