Capital One TCPA Class Action Settlement – Capital One has agreed to settle a class action lawsuit that alleges it violated the Telephone Consumer Protection Act by using an automatic telephone dialing system and/or an artificial prerecorded voice to call cell phones without the prior express consent of the recipients. If you received a call on your cell phone from Capital One in connection with an attempt to collect on a credit card debt, you may be entitled to benefits from the TCPA class action settlement!

Fla. Man Files Xarelto Lawsuit – The anticoagulant Xarelto can cause uncontrollable internal bleeding, a Florida man alleges in a recent lawsuit. The plaintiff alleges he suffered a life-threatening, irreversible bleed as well as pain and suffering as a result of taking the drug. According to his Xarelto lawsuit, the manufacturers and their subsidiaries concealed their knowledge that the drug can cause life-threatening bleeds.

Class Action Settlement Checks Arrive for Michigan Student Loan Borrowers – Student loan borrowers are receiving payments in the mail from a class action settlement over the former Michigan Students First Borrower Benefit Program, which was cancelled in 2010 by the Michigan Finance Authority. Under the terms of the student loan settlement, Class Members were eligible to receive up to $1,200, based on the original amount of the loan and whether it is still held by MFA.

Risperdal Gynecomastia Link Stronger than Thought, Study Says – According to a new study, the antipsychotic drugrisperidone (Risperdal) significantly increases the risk of gynecomastia in older men. Gynecomastia is a medical condition in which male breast tissue becomes unnaturally enlarged. The manufacturers of Risperdal have been sued by a number of young men and their families over cases ofgynecomastia allegedly caused by Risperdal.

Ghirardelli to Settle White Chocolate False Ad Class Action Lawsuit – Plaintiffs are seeking the preliminary approval of a false advertising settlement against Ghirardelli Chocolate Company. The class action lawsuit alleges Ghirardelli’s advertising could deceive consumers into believing some of its products contain white chocolate and/or all natural ingredients. If approved, Ghirardelli consumers could be entitled to cash benefits from the class action settlement.

FDA Panel Reviews Morcellator Cancer Risk in Fibroid Removal Surgery – Due to rising concerns about the risk of uterine cancer being spread by power morcellatorsused during uterine fibroid removal surgery, an FDA committee has been discussing recommendations for minimizing the risk. If you or a loved one were diagnosed with cancer in the uterus, pelvis or abdomen after a laparoscopic power morcellationprocedure, you may have a legal claim.

Hyundai, Kia Fuel Economy Class Action Settlement Approved – A California federal judge has preliminarily approved a class action settlement over allegations Hyundai and Kia overstated the fuel efficiency of some of their vehicles. The fuel efficiency settlement will provide cash payments to current owners and lessees of certain Hyundai and Kia vehicles.

Lawsuit Alleges Actos Caused Fla. Man’s Bladder Cancer – A Florida couple has sued Takeda Pharmaceuticals, alleging the diabetes drug Actos led the husband to develop bladder cancer. If you or a loved one developed bladder tumors or bladder cancer after taking Actos, you have legal options.

$1.65M Class Action Settlement Reached over Pure Via Product Labeling – A settlement has been reached in a class action lawsuit over the allegedly deceptive marketing of Pure Via products. The Pure Via lawsuit alleged the manufacturers misleadingly labeled, advertised and marketed the product as a natural sweetener that was primarily derived from the stevia plant. Consumers who purchased Pure Via products may be eligible for cash benefits from the class action settlement.

New Study Could Have Implications for Lipitor Diabetes Lawsuits – The British Medical Journal has published a paper suggesting Lipitor’s risk may outweigh its risks. Pfizer, Lipitor’s manufacturer, is currently facing a number of Lipitor lawsuits alleging it downplayed the risk of diabetes associated with the drug.

Update from the President and CEO of Top Class Actions 

Good morning! Did you have a great week? I hope so! I had fun playing with the girls (along with plenty of work ;). I’m “working out” again and even though it’s just been a few weeks I already feel a positive change in energy. I don’t just look at pool time with the girls or heading up and down the stairs dozens of times a day as my exercise. Now I’m working out INTENSELY three days a week. It’s great! Most importantly I’m having an easier time doing fun things with the girls like chasing them (the tickle monster is always on call) and throwing them up in the air, and “dancing.” Dancing usually means picking one (or both) up and spinning around with an occasional lift towards the sky. It’s nice to be able to keep up with them a LITTLE more. I know in a few years dancing with Daddy won’t be a priority so I have to take it all in now! Fun for the girls and fun for me!

On the Top Class Actions side we had a busy week of new projects for our great clients, some of which will be GREAT for you! I can’t wait to release them! We’ve been busy sending out reports, proposals and other paperwork to our clients so hopefully they’ll go up over the next few weeks. We’re also about to migrate onto another hosting platform. Fingers crossed it goes without any problems. Naturally, because I like to make things more difficult, I’m making it happen over Labor Day weekend. The new host SHOULD speed things up and increase our reliability significantly.
