A settlement has been reached with Schnuck Markets Inc. in a class action lawsuit over a security breach that occurred between Dec. 9, 2012 and March 30, 2013. If you used a debit or credit card at Schnucks during this time period, you could be eligible for compensation from the class action settlement.

On March 30, 2013, Schnucks announced that its computer systems had been compromised due to a malicious computer code on its systems, which targeted data in the magnetic stripe of credit and debit cards swiped at 79 Schnucks stores.

The Schnucks data breach class action lawsuit alleges Schnucks was responsible for the security incident because it did not take appropriate care to protect its systems from hackers. Schnucks denies the allegations but agreed to settle the class action lawsuit to avoid the risk and cost of a trial.

Who’s Eligible

Class Members of the Schnucks data breach settlement include anyone who used a credit or debit card at a Schnucks store between Dec. 9, 2012 and March 30, 2013.

Potential Award

Three types of payments are available from the Schnucks class action settlement:

  1. Out-of-pocket expenses and lost time (up to $200);
  2. $10 payments per card for those who had fraudulent charges that were later reversed or credited back to the credit or debit card account; and
  3. Reimbursement of extraordinary unreimbursed monetary losses (up to $10,000)

Class Members may submit a claim for all three types of payments or any combination.

Under the terms of the Schnucks class action settlement, out-of-pocket and lost time stemming from the security incident may include the following:

  • Unreimbursed bank fees
  • Unreimbursed card reissuance fees
  • Unreimbursed overdraft fees
  • Unreimbursed charges related to unavailability of funds
  • Unreimbursed late fees
  • Unreimbursed over-limit fees
  • Long distance telephone charges
  • Cell minutes, internet usage charges and text messages, if charged based on time or usage and incurred because of the security incident
  • Unreimbursed charges from banks or credit card companies
  • Postage
  • Interest on payday loans due to card cancellation or over-limit situation
  • Up to three hours of documented lost time at $10 per hour spent dealing with replacement card issues or reversing fraudulent charges
  • Costs of credit report(s)
  • Costs of credit monitoring and identity theft protection (up to $80)
Proof of Purchase

Class Members must provide documentation of their expenses related to the Schnucks data breach.

    I don’t like the fact that a claimant has to submit their credit card(s) information. Who knows who is looking at that info? No thanks.

    My insurnance rate is extremely costly in Nevada for full coverage. I lived in Illinois prior to moving to Henderson, NV. I do have a licensed driver.
