Big 5 Sporting Goods Corporation has agreed to settle a class action lawsuit alleging the company violated California law by asking customers to provide their ZIP codes or other identifying information in connection with credit card purchases. If you made a purchase using a credit card at any California Big 5 store between Feb. 14, 2007 and Feb. 23, 2011, and were asked to provide your ZIP code and/or any other personal information, you could be entitled to benefits from the Big 5 class action settlement.
Big 5 denies any wrongdoing, but has agreed to settle the ZIP code class action lawsuit to avoid the expense, inconvenience and risk of ongoing litigation.
Who’s Eligible
Class Members of the Big 5 ZIP code settlement include: “All persons who made an in-store purchase using a credit card at any Big 5 Sporting Goods retail Store in California between February 14, 2007 and February 23, 2011, and who were asked to provide personal identification information, including their physical address, ZIP code, or telephone number, and who did provide such information, which was then recorded by Big 5.”
Potential Award
Class Members may make a claim for a merchandise voucher worth $10 or a gift card in the amount of $25. These awards are subject to a pro rata reduction depending on the total number of claims filed. Class Members are limited to one voucher or gift card. Each household is limited to a combined total of four vouchers and gift cards.
Proof of Purchase
Class Members who make a claim for a $25 gift card must provide proof of purchase such as a receipt or credit card statement.
Class Members without proof of purchase must certify under the penalty of perjury that they were requested to provide, and that they did provide, a ZIP code or other personal information to Big 5 during a credit card transaction during the Class Period.
