Patenaud & Felix, a debt collector who obtained debts from Target, has agreed to pay a settlement of $15,700 to end claims that the retail giant violated the Fair Debt Collection Practices Act in sending out a specific kind of debt collection letters.
Allegedly, this debt collection letter was sent in an attempt to collect debts owned on a Target credit card.Â
Class Members include all of those customers in the United States who were sent a letter attempting to collect on a consumer debt in the year before the Target debt collection class action lawsuit was filed. The settlement website includes the court documents which describe the debt collection letter in more detail.Â
The Target credit card debt collection class action lawsuit was filed by Amanda Acosta, a San Diego resident. She alleged that around April 2019, she took out a retail consumer credit line for Target. She says that she incurred a debt that then went into arrears, at which point Patenaud & Felix sent out a debt collection letter.
She states that the letter was sent on April 22, 2019, and listed a balance due and a due date. Allegedly, the due date listed was 24 days from the date of the correspondence in violation of the Fair Debt Collection Practices Act.
According to Acosta, the letter does not present the obligations of the consumer in a clear manner, nor does it give consumer adequate opportunity to dispute the letter, as the law requires. The Target debt collection class action lawsuit asserts that similar unlawful letters were sent to many consumers.
Class Members can now submit claims for benefits from the Target credit card debt collection class action settlement on the settlement website. The total benefits that Class Members can receive depends on the number of claims filed. For her role as lead plaintiff in the Target debt collection practices class action lawsuit, Acosta is eligible to receive $750.
Target credit card settlement benefits will be made available to the Class after and if the settlement is granted final approval. Class Members must cash their checks within 60 days of receiving them.
If there is an amount of money left over from the uncashed checks, a second round of checks will be sent to Class Members who did cash their checks — if the amount that each Class Member would receive is more than $5.
Class Members who wish to receive benefits must file a benefits claim by Aug. 3, 2020. A claim form can be filed online or by mail. Class Members’ rights are affected whether or not they choose to file a claim for benefits — those that remain in the Class either by filing a claim or opting out will lose their rights to pursue independent litigation against Patenaud & Felix over the Target debit card issue.Â
Class Members who wish to opt out and retain their rights to independent litigation must do so by Aug. 3, 2020. Class Members are invited but not required to attend a final approval hearing on Sept. 10, 2020.Â
