NaviHealth has agreed to pay $4.7 million to end allegations that they failed to pay their nurses employee overtime wages.

The settlement benefits individuals who worked for one or more work weeks as Care Management Employees outside of California during the three years prior from either the date that their opt-in form was filed or April 12, 2019, whichever is earlier, to Dec. 12, 2019. Some Class Members may have previously filed out an opt-in form to participate in the collective action.

Plaintiffs in the naviHealth collective action claimed that the company failed to provide their nurses with the employee overtime wages they were owed. These alleged violations reportedly flouted employee overtime regulations such as the federal Fair Labor Standards Act and the Pennsylvania Minimum Wage Act.

The nurses reportedly did care management work by arranging appointments, discussing health plans, and performing other tasks. However, despite the role they played, naviHealth allegedly classified these employees in a way which denied them overtime wages.

NaviHealth has not admitted to any wrongdoing but has agreed to resolve the claims against them in a $4.7 million class action settlement. The company maintains that they properly classify their clinicians under the FLSA, but notes that the settlement provides a way to resolve the issue without going to trial. Similarly, the plaintiffs say that the settlement provides significant relief which would have otherwise been uncertain.

“Absent settlement, if defendant is successful in opposing certification and/or limiting notice (or later in decertifying the case), the plaintiffs would be forced to litigate their FLSA and/or state law claims in individual actions, a result that would be time-consuming, expensive and require individualized inquiries and the participation of all individual plaintiffs,” the plaintiffs wrote in their settlement motion.

“This settlement, on the other hand, makes significant monetary relief available to class members in a prompt and efficient manner.”

Under the naviHealth settlement, Class Members will be able to recover cash payments comprising backpay and liquidated damages. Payments of at least $100 are guaranteed to all claimants, although exact payments will vary depending on a Class Member’s regular rate of pay, the number of weeks worked during the recovery period, and other factors.

In order to benefit from the naviHealth settlement, Class Members must file a valid claim form by July 28, 2020.

To file a claim online, Class Members need to use a claimant ID number which should be located on the notice sent to them via the mail. Any Class Members who did not receive a notice can contact the settlement administrator.

Objections to the naviHealth settlement and opt out requests are also due by July 28, 2020. The final approval hearing for the settlement is scheduled for Sept. 21, 2020.

Who’s Eligible
