Six Flags Class Action Lawsuit Overview:

  • Why: Season pass holders claim Six Flags continued to charge them while its parks were closed due to the COVID-19 pandemic. 
  • Where: The class action lawsuit was filed in Illinois’ Circuit Court of Cook County. 

Six Flags has settled a class action lawsuit filed over allegations it continued charging season pass holders while its amusement parks were closed due to the COVID-19 pandemic. 

Season pass holders with active or paused memberships that were affected by the closures will be granted free park admission for varying amounts of time to any of the 26 Six Flag parks under the settlement agreement, reports the Cook County Record

Alternatively, members can choose to receive a gift card filled with the monetary amount that was charged for each month while the parks were closed. 

Season pass holders with active or paused membership statuses will also be given access to membership benefits and given “upgraded membership status,” which grants them more benefits and perks.

Members who ended up canceling their passes will be given a complimentary ticket for each six months that they were improperly charged during the closure period, reports the Cook County Record.

Plaintiff Ryan Strassburger claimed Six Flags continued collecting monthly membership fees — ranging from $7.85 to $42 despite closing all of its parks right before the spring and summer 2020 operating season because of the COVID-19 pandemic. 

Strassburger says he purchased his membership so he could primarily go to Six Flags Great America, located in Illinois, which remained closed throughout 2020, despite other locations reopening during the year. 

It took around 11 months of litigation for the sides to come to an agreement, reports the Cook County Record. Cook County Circuit Judge Sophia Hall granted preliminary approval to the settlement on Sept. 10 and a final approval hearing is scheduled for Dec. 15.

A similar class action lawsuit was filed last year against Cedar Fair — which operates 13 amusement parks around the country — by season pass holders who argued they deserved a refund for the 2020 season on account of park closures

    I was charged many many months during the pandemic. Even after my year was up they continued to charge me on a month to month basic. They only cancelled once I sent numerous emails.
