Aaron’s Furniture and Appliances has agreed to pay $2.175 million to resolve claims that the company violated federal law by placing robocalls.

The settlement benefits individuals who received at least one call with Genesys Interactive Intelligence System and/or an artificial or prerecorded voice from Aaron’s Furniture between June 8, 2014 and May 1, 2020. Class Members’ phone numbers must have been associated with a “wrong party” code in Aaron’s records.

Several plaintiffs filed their class action lawsuit against Aaron’s in June 2018. The plaintiffs claimed they had been called by the furniture company without giving their consent. The calls were allegedly placed for telemarketing purposes and used an automatic telephone dialing system and/or an artificial or prerecorded voice.

According to the plaintiffs, the robocalls they received violated the federal Telephone Consumer Protection Act (TCPA). The TCPA prohibits businesses from contacting consumers with unsolicited telemarketing calls, texts or faxes. An existing business relationship isn’t enough to justify these telemarketing robocalls. Instead, the recipients must have provided their express written consent in order for the calls, texts and faxes to be legal.

Under TCPA, consumers who receive robocalls, spam texts or junk faxes in violation of the law may be able to recover up to $1,500 in damages per violation. If multiple calls or texts were received, this can add up to thousands of dollars for affected consumers.

Aaron’s Furniture and Appliances has not admitted any wrongdoing but has agreed to pay $2.175 million to resolve the claims against them. Settling the claims under TCPA allows the plaintiffs to secure compensation and allows both parties to avoid the risks of continued litigation.

The settlement provides cash payments which will be distributed equally amongst the Class, payments will depend on the number of valid claims filed. Any uncashed awards may be distributed amongst claimants in a second round of checks.

In order to benefit from the Aaron’s Furniture and Appliances class action settlement, Class Members must file a valid claim form by Sept. 8, 2020. Class Members are only required to submit the phone number they received robocalls on, which will be used to validate claims through Aaron’s records.

The deadline for exclusion and objection is Aug. 10, 2020. Excluding oneself from the settlement will give up any right for compensation but allows Class Members to take legal action against Aaron’s in the future for the same issue. Objecting to the settlement allows Class Members to remain in the settlement but voice their opposition to some or all of the settlement terms.

The final approval hearing for the Aaron’s Furniture class action settlement is Oct. 1, 2020. Class Members are invited to attend the hearing but are not required to do so.

Who’s Eligible

      I filed and they put in an email that I was denied cause my phone number was not on claim. I have copy of claim and my phone number is there. Now I get no email back after I showed proof. All this shows me is we should all get together and put a class action suit against the ones that choose how gets what. And for lying.
