Aaron’s Telemarketing Calls Settlement Checks
Consumers who received one or more unsolicited robocalls telemarketing for Aaron’s Furniture and Appliances between June 8, 2014, and May 1, 2020, and who participated in a class action lawsuit against the company are now getting checks for $142.50 each.
The payments are part of a $2.175 million settlement negotiated between the plaintiffs and Aaron’s to resolve claims the automated calls violated the U.S. Telephone Consumer Protection Act (TCPA), which prohibits unsolicited automated telemarketing phone calls and text messages.
The class action was filed against Aaron’s in June 2018 by several consumers who said they’d gotten the nuisance robocalls even though they hadn’t given their prior written consent to be contacted.
Aaron’s admits no wrongdoing, under the terms of the settlement, but agreed to settle the case before it went to trial.
The Aaron’s Telemarketing Calls Class Action Lawsuit is Grogan, et al. v. Aaron’s Inc. d/b/a Aaron’s Sales & Lease Ownership and Aarons.com, Case No. 1:18-cv-02821, in the U.S. District Court for the Northern District of Georgia.
Truluck’s Data Breach Settlement Checks
The owners of Truluck’s restaurants are sending settlement checks for $25.41 to those who participated in a class action lawsuit against the company over a data breach.
While Truluck’s admits no wrongdoing, the company agreed to settle with the customers of its eateries in Florida, Illinois and Texas who accused it of failing to protect their sensitive data from a 2018 breach. That data included their customer payment information, putting the customers at risk of credit and identity theft, they claimed.
According to the class action lawsuit, the data breach involved point-of-sale systems used between Nov. 21 and Dec. 8, 2018.
The class action lawsuit accused Truluck’s of not doing enough to prevent the breach and safeguard its customers from potential risks. In addition to the financial settlement, the company agreed reinforce its data security practices and to maintain those upgrades for a least the next three years.
The Truluck’s Data Breach Class Action Lawsuit is Ramsey v. 41 E. Chestnut Crab Partners LLC, et al., Case No. 2019 CH 2759, in the Circuit Court of Cook County, Chancery Division, Chicago, Illinois.
Testofen Natural Testosterone Booster Settlement Checks
Some consumers who purchased Testofen natural testosterone booster and claimed the company that manufactured it deceived them about its benefits are getting checks for $14.52.
The payments are part of a $7 million class action lawsuit settlement, which won final court approval in October 2018.
According to the plaintiffs, Testofen — which admits no wrongdoing — misled them by advertising and marketing various supplements as being effective in treating numerous conditions affiliated with low testosterone levels in men. The company allegedly claimed the products were clinically tested and proven to produce “improved orgasms, improved cognition … fat loss, heightened libido, enhanced sexual performance, strengthened blood flow … improved power and/or stamina.”
In their class action lawsuit, the plaintiffs argued the company had no scientific evidence to support the claims.
The Testofen Natural Testosterone Booster Class Action Lawsuit is Robbins v. Gencor Nutrients Inc., Case No. 16AC-CC00366, in the Circuit Court of Cole County, Missouri.
