Momentum Solar broke the law by calling individuals on the National Do Not Call List without their consent, a new class action lawsuit alleges.
Lead plaintiff George Moore claims the company’s use of a telemarketing campaign to market its goods and services violated the Telephone Consumer Protection Act of 1991 (TCPA). Moore wants to represent a nationwide Class of consumers who received similar calls from the company on phone numbers they put on the do not call list.
Moore says he never sought out information about Momentum Solar before he received “several calls” from the company – despite his number being registered on the National Do Not Call List – attempting to sell him on the idea of investing in its goods and services.
Consumers are able to register their phone numbers on the National Do Not Call Registry to indicate they do not want to receive any telephone solicitations. “A listing on the Registry ‘must be honored indefinitely, or until the registration is cancelled by the consumer or the telephone number is removed by the database administrator’,” states the class action lawsuit.
The TCPA, meanwhile, regulates the telemarketing industry and is a recognition by Congress that unrestricted telemarketing is intrusive and an invasion of privacy, according to the class action lawsuit.
The Federal Communications Commission (FCC) is required by the TCPA to “initiate a rulemaking proceeding concerning the need to protect residential telephone subscribers’ privacy rights to avoid receiving telephone solicitations to which they object,” according to the class action lawsuit.
Nuisance Momentum Solar Calls Violate Do Not Call List
Moore alleges his privacy was violated by the Momentum Solar, that he was subjected to annoying and harassing calls that constituted a nuisance, had his phone line tied up, and was not provided with his express written consent that the calls could be placed.
The plaintiff is demanding a jury trial and seeking injunctive relief and treble damages of up to $1,500 for himself and all Class Members.
A similar class action lawsuit was filed earlier this month against Grand Caribbean Cruises alleging it violated the TCPA by sending pre-recorded messages to customers without their consent.

I’m receiving a call every day from this momentum solar company, even after telling them i’m not interested. They dont use donot call list and keep on calling using different numbers. How to stop this??
