Humana prerecorded messages class action lawsuit overview: 

  • Who: Lisa Ricketts filed a class action lawsuit against Humana Inc. 
  • Why: Ricketts claims Humana placed unlawful pre-recorded promotional messages. 
  • Where: The class action lawsuit was filed in Florida federal court. 

Humana Inc. violates the law by using pre-recorded messages to promote the sale of its health insurance plans, a new class action lawsuit alleges. 

Plaintiff Lisa Ricketts claims Humana routinely contacts consumers with automated sales calls without their consent and/or who have no connection to the benefits the company is trying to  offer. 

Ricketts argues Humana has harassed her with the pre-recorded phone calls for months and that she never provided the health insurance company with her telephone number or any consent to contact her. 

“Defendant’s unsolicited calls caused Plaintiff harm, including invasion of privacy, aggravation, and annoyance,” the Humana class action states. 

Ricketts wants to represent a nationwide class of consumers who received more than one automated pre-recorded cell phone call from Humana within the last four years. 

Humana uses pre-recorded messages to contact consumers since they are more efficient and less expensive than using a live agent, the Humana class action alleges. 

“Defendant can attempt to contact more individuals using a prerecorded message than it can by placing a manual call,” states the Humana class action. 

Humana’s pre-recorded phone calls a violation of rights, says class action

Ricketts argues that, in addition to an invasion of privacy, the pre-recorded phone calls were an inconvenience, a disruption to her daily life, and a violation of her rights. 

“Plaintiff never provided Defendant with her telephone number, and never gave Defendant any type of consent or permission to contact her with prerecorded voice calls,” states the Humana class action.

Ricketts claims Humana violated the Telephone Consumer Protection Act. She is demanding a jury trial and requesting declaratory and injunctive relief along with an award of statutory and treble damages for herself and all class members. 

In a separate case, Humana — along with Cotivi — agreed to a class action settlement made to resolve claims the companies put consumer data in danger during a 2020 data breach.

    I have received dozens of pre-recorded message.They were calling so many times a day leaving on my voice mail.a live person even called me I told them to take me off list.They continued about a month from different numbers.i still have on my voice mail.i would like to sign up for this suit for harassment.
