GoodRx shared its customers’ medical information with platforms like Meta, Google and Criteo, without their permission, a new class action lawsuit alleges.

Plaintiff Jose Marquez filed the class action lawsuit against GoodRx Holdings Inc., Meta Platforms Inc., Google LLC and Criteo Corp. on March 2 in a California federal court, alleging violations of state and federal consumer laws.

According to the lawsuit, GoodRx collects personal information both from its users themselves and other information from pharmacies. Since January 2017, more than 55 million consumers have visited or used GoodRx’s website or mobile apps, the lawsuit states.

Since 2017, GoodRx has promised its users it would never share personal health information with advertisers or other third parties, Marquez states. GoodRx further promised it would only use personal information in “limited cases,” such as to fulfill a user’s request for a specific prescription coupon.

However, despite its policies, “GoodRx repeatedly violated its promises to users by sharing sensitive user information with third- party advertising companies and platforms like Meta, Google, and Criteo without providing notice to its users or seeking their consent,” Marquez alleges. 

Private information shares includes medical health conditions, lawsuit alleges

The information shared with third parties included GoodRx’s users’ prescription medications, personal health conditions, contact information, and unique advertising and persistent identifiers, the lawsuit states.

“GoodRx permitted these third parties — some of the most prominent social media companies in the United States — to use and profit from the information for their own business purposes,” the lawsuit says.

By incorporating their tracking technology on the GoodRx Platform, Meta, Google and Criteo, also knowingly and intentionally intercepted people’s personal health information, the lawsuit states.

“Defendants’ interception and disclosure of users’ private information without consent constitutes an extreme invasion of Plaintiff’s and Class members’ privacy.” 

The plaintiff seeks to represent all California residents who accessed and used the GoodRx website, goodrx.com, and the GoodRx mobile apps.

Marquez is suing for violations of California privacy laws and laws protecting medical records, and accuses the company of unjust enrichment. He seeks certification of the class action, damages, fees, costs and a jury trial.

Meanwhile, the Federal Trade Commission (FTC) has fined GoodRx $1.5 million, alleging the telehealth company was secretly sharing its customers’ health data with third parties for advertising purposes, a violation of privacy.
