Credence Resource Management Call Recording Class Action Lawsuit Overview:

Credence Resource Management willfully broke the law and violated the privacy of consumers by recording cell phone calls without their consent, a new class action lawsuit alleges.
Lead plaintiff Richard Bullen claims Credence Resource Management violated his constitutionally protected right to privacy by failing to disclose it was recording phone calls made to him. Bullen wants to represent a California Class of consumers who were allegedly recorded by the company without their knowledge or consent.
Bullen says he received an outbound call by the defendant trying to collect after he became delinquent on debt. The content of the phone calls was recorded by Credence Resource Management without any warning, the class action lawsuit alleges.
Failure to disclose you are recording a phone call is a violation of California’s Invasion of Privacy Act, which says it is illegal to record phone calls unless everyone on the call is aware they are being recorded.
According to the class action lawsuit, the “Defendant violated [the] Plaintiff’s constitutionally protected privacy rights by failing to advise or otherwise provide notice at the beginning of the conversation(s) with Plaintiff that the calls would be recorded, and Defendant did not try to obtain Plaintiff’s consent before such recording.”
Bullen is requesting $5,000 in statutory damages per violation — the max amount set by the state — for himself and for all Class Members.
Multiple Class Action Lawsuits Claim Debt Collection Agencies Have Recorded Calls Without Permission
Similar class actions lawsuits have made news recently. Earlier this month, a class action lawsuit was filed by a Spectrum customer alleging the company illegally recorded a phone call without her consent.
Wells Fargo, meanwhile, reached a $28 million class action settlement this month with customers who alleged telemarketers working on the company’s behalf had recorded phone calls without permission.
