Truluck's data breach allegations have ended in a class action settlement.

Owners of Truluck’s restaurants agreed to pay a settlement to end claims that the company did not sufficiently protect consumers from a 2018 data breach. 

Class Members include all of those consumers who used a credit or debit card at an affected Truluck’s Restaurant between Nov. 21, 2018 and Dec. 8, 2018. The settlement provides a complete list of affected restaurants.

Consumers claimed that some Truluck’s restaurants located in Florida, Illinois, and Texas were affected by a third-party data breach in 2018. Specifically, the customers argued that this data breach affected point-of-sale systems and were aimed at stealing customer payment card information. 

The Truluck’s data breach class action settlement asserted that the company could have taken further precautions to safeguard the point-of-sale systems. Allegedly, the data breach put customers at risk for identify theft, fraud, and financial injury. 

Truluck’s does not admit any wrongdoing, but has agreed to settle with consumers in the interest of not incurring more risks and costs associated with litigation. The settlement provides cash benefits to consumers and, as part of the agreement with consumers, the business has changed certain data security practices and will continue employing these new practices for at least three years. 

Class Members are eligible to receive up to $2,520 as benefits from the Truluck’s class action settlement. Class Members are divided into two tiers, and are eligible for benefits based on what category that they are in.

Class Members are eligible for Category 1’s one-time payment of around $20 if they made a credit or debit card purchase at one of the affected Truluck’s Restaurants between Nov. 21, 2018 and Dec. 8, 2018.

Category 1 Class Members do not need to have experienced fraudulent or unauthorized charges after they made their purchase. According to the settlement website, the payment be be more than or less than $20, and can be up to $30. The amount of money that each Class Members will receive depends on the number of claims filed.

Category 2 Class Members are those who did experience fraudulent or unauthorized charges on their account after using a debit or credit card to make a purchase at a Truluck’s between Nov. 21, 2018 and May 14, 2020. These consumers are eligible for a one-time payment of $20 plus up to $2,500 to compensate for fraudulent purchases. Category 2 consumers must provide documentation for these charges, and proof that they were not reimbursed for the charges. The settlement website notes that these documents could include a credit or debit card statement or other communications or correspondences about the charges.

To file a benefits claim, consumers can fill out a claim form online or may mail it in to the settlement administrator. The deadline to file a claim is Aug.12, 2020. 

Consumers who do not wish to receive benefits and instead wish to retain their rights to pursue  independent litigation against Truluck’s may opt out of the settlement by July 28, 2020. Consumers who wish to object to the settlement must do so by July 28, 2020. A final approval hearing is set for Oct. 15, 2020.

    the more add mes the more money 4 me. u can preach it 2 them a 1000 x u hv 2 fill out a form 2 get paid. n they still ADD ME. I just gave up on them a long x ago. i just SMH when i c ADD ME
