Startek agreed to a class action settlement to resolve claims it failed to protect employees from a 2021 data breach.

The settlement benefits consumers who were mailed a notification that their personal identifying information may have been compromised in a Startek data breach June 26, 2021; 24,819 individuals were reportedly sent data breach notifications.

In January 2022, Startek sent data breach notifications to current and former employees informing them their information may have been compromised when an unauthorized user accessed the company’s systems and acquired documents. 

Affected consumers took legal action against Startek, arguing they suffered injuries when hackers accessed their names, dates of birth and Social Security numbers. According to plaintiffs in the case, Startek could have prevented these injuries by implementing reasonable cyber security measures. 

“Plaintiff’s and Class Members’ identities are now at risk because of Defendant’s negligent conduct since the Private Information that Defendant collected and maintained is now in the hands of data thieves,” the data breach class action lawsuit claims.

The plaintiffs also challenge how long it took for Startek to discover the data breach. Despite the breach occurring in June 2021, Startek allegedly failed to discover the breach until December 2021. According to the class action lawsuit, Startek failed to properly monitor its systems for breaches which caused the data breach to go undiscovered for months.

Startek hasn’t admitted any wrongdoing but agreed to pay an undisclosed amount to resolve these allegations.

Under the terms of the Startek data breach settlement, class members can submit a claim for documented ordinary and extraordinary losses resulting from the data breach. Class members can receive up to $500 for ordinary losses, including credit monitoring, identity theft insurance, fees and up to four hours of lost time at a rate of $15 per hour. The settlement also allows for up to $4,500 in compensation for extraordinary losses, including fraud and identity theft.

All class members are eligible for two years of free credit monitoring and identity-theft protection services through Experian. Consumers who previously enrolled for the year of services offered following the Startek data breach announcement will have two years automatically added to their services without taking any action. Class members who did not enroll for this initial coverage will need to submit a claim to receive the services.

The deadline for exclusion and objection is Jan. 23, 2023. 

The final approval hearing for the Startek data breach settlement is scheduled for April 13, 2023. 

In order to receive settlement benefits, class members must submit a valid claim form by Feb. 21, 2023.
