Ambry Genetics agreed to a $12.25 million settlement to resolve claims that a 2020 data breach compromised consumer health data and other identifiers.

The settlement benefits patients whose personal health information or personal identifying information was contained in an employee’s compromised email during a January 2020 data breach. Around 225,370 patients were affected by this breach.

In April 2020, Ambry Genetics — a California-based genetic testing lab — announced an email security breach had compromised the information of hundreds of thousands of patients. The hackers reportedly gained access to protected health information and other identifiers through an employee’s email account. 

Affected patients took legal action against Ambry, arguing the company had a duty to protect their information and failed to do so. Plaintiffs in the consolidated class action lawsuit claim Ambry Genetics could have prevented the data breach through reasonable cyber security measures such as employee training.

Ambry hasn’t admitted any wrongdoing but agreed to a $12.25 million class action settlement to resolve these allegations.

Under the terms of the settlement, class members can receive up to $10,000 in reimbursement for out-of-pocket expenses related to the data breach. This includes credit-related costs, record expenses, replacement costs for IDs and more. To receive this reimbursement, class members need to provide documentation.

Class members can also receive compensation for lost time by claiming up to 10 hours of documented lost time at a rate of $30 per hour, for a maximum lost time payment of $300. 

Class members who do not make a claim for documented lost time may be able to receive an alternate payment for up to three hours of undocumented lost time at a rate of $30 per hour, for a maximum lost-time payment of $90.

Class members who were residents of California or Illinois between Jan. 22, 2017, and Oct. 5, 2022, may receive additional cash payments.

All class members are eligible for three years of free credit monitoring. The settlement offers Identity Defense Total and Pango’s Identity and Privacy Monitoring Services. These benefits include up to $1 million in fraud and identity theft insurance, three-bureau credit monitoring, monthly credit score reports, high-risk transaction alerts, dark web monitoring and more.

Consumers will also benefit from Ambry’s remedial measures and enhanced security measures. The company has agreed to improve its training and policies to prevent similar data breaches from occurring in the future. This will protect class member information still retained by Ambry.

The deadline for exclusion and objection is Jan. 9, 2023. 

The final approval hearing for the Ambry Genetics data breach settlement is scheduled for March 6, 2023.

In order to receive settlement benefits, class members must submit a valid claim form by Feb. 7, 2023.
