Public Employees Credit Union (PECU) agreed to a class action settlement to resolve claims it failed to protect its clients from a 2022 data breach.

The settlement benefits individuals who received a written notice that their personal identifying information was potentially compromised in a Public Employees Credit Union data breach discovered April 26, 2022.

The data breach class action lawsuit claims current and former PECU customer information was compromised by the breach, including customer names, addresses, financial account information, social security numbers and more. Plaintiffs in the case contend that PECU failed to protect their information through reasonable cyber-security measures. 

Public Employees Credit Union is a not-for-profit cooperative based in Austin, Texas. The credit union offers checking accounts, savings accounts, loans, insurance and more. 

PECU hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the data breach allegations.

Under the terms of the Public Employees Credit Union settlement, class members can receive reimbursement for out-of-pocket expenses and lost time related to the data breach. 

The settlement terms allow for up to $500 in ordinary losses such as bank fees, communication charges, travel expenses, credit costs and up to three hours of lost time at a rate of $20 per hour. 

Class members can receive an additional $2,500 if they experienced extraordinary losses including unreimbursed monetary losses related to the data breach. This could include fraudulent bank charges that were not reimbursed or costs related to identity theft.

All class members can receive one year of credit monitoring services through the settlement, even if they did not suffer from monetary losses or lost time. Individuals who previously enrolled for credit monitoring offered by PECU can have their services automatically extended by one year.

Public Employees Credit Union also agreed to make cybersecurity-related changes through Dec. 21, 2023, to better protect client information. 

The deadline for exclusion and objection is April 4, 2023.

The final approval hearing for the settlement is scheduled for June 9, 2023.

In order to receive settlement benefits, class members must submit a valid claim form by May 4, 2023.
