Progress Software data breach class action lawsuits overview:Â
- Who: Four consumers have filed class action lawsuits against Progress Software Corp. and, uniquely, Arietis Health LLC, Cadence Bank, the University of Missouri System and Flagstar Bank N.A.Â
- Why: The consumers claim their entities failed to adequately safeguard and secure consumers’ data during data breaches that occurred following a cyberattack against Progress Software’s MOVEit file transfer software in May.Â
- Where: The class action lawsuits were filed in Massachusetts federal court.Â
Multiple class action lawsuits have been filed against Progress Software Corp. and other entities that were affected by data breaches that occurred as a result of a cyberattack against the company’s MOVEit file transfer software in May.Â
The complaints — numbering four in total — target Progress Software and, individually, Arietis Health, Cadence Bank, the University of Missouri (UM) System and Flagstar Bank.Â
In each case, consumers argue the entities failed to adequately safeguard and secure sensitive private information that they had collected and maintained.Â
Individually, the data breaches affected nearly 800,000 consumers connected to Flagstar Bank, nearly 2 million connected to Arietis Health and an unspecified amount connected to Cadence Bank and the UM System.Â
Consumers allegedly weren’t told fast enough about data breaches related to MOVEit hack
The complaints also each claim the entities took too long to disclose the data breaches to them, with Flagstar Bank, Arietis Health, Cadence Bank and the UM System accused of waiting more than four months, two months, three months and two months, respectively.Â
The consumers claim Progress Software and their unique defendant are guilty of negligence, unjust enrichment and breach of implied contract and fiduciary duty.Â
The plaintiffs are all demanding a jury trial and requesting declaratory and injunctive relief along with an award of punitive damages and actual, statutory, compensatory and nominal damages and/or statutory penalties for themselves and all class members.Â
A similar class action lawsuit was filed against Progress Software, Pathward NA and Ipswitch Inc. last month over claims they failed to adequately safeguard consumers’ sensitive data prior to a May 2023 data breach connected to the MOVEit file transfer software hack.Â

I’m a long-time Comcast customer, and I did have a data breach. Add me to this one.
I received a phone call several months ago and a message was left on my recorder saying it was Xfinity offering a deal and I needed to reply and it was by that particular day. It sounded enticing but I did not call. Since that offer sounded good I decided to go to the local Xfinity store and ask about it. They said it was a good thing I didn’t call and respond because it was a scam. I deleted the message and didn’t think anymore about until I just read about this lawsuit.

My email password pause compromise I don’t know how deep I’m still looking into it but got affected, but my email was contracted with Comcast attached to Comcast Xfinity or whatever they want to call their self now these days but I have to make a new password hopefully no major information got out, but I don’t know yet I just know some of my accounts was hacked because they lack the security for the customers
I am a victim of the PBI/MOVEit hack in May. My Jackson National, Delaware Life and an account which has not admitted the breach-probably Prudential. My SS # and all ID was taken. My Delaware Life account number was even taken and there are no internal passwords or other security. They are being unjustly enriched by charging thousands of dollars for early withdrawal. Additionally I was a victim of a hack directly to their own software in February which also took the account number. I learned of it only 3 weeks ago.
