Dish Network Corp. is facing a class action lawsuit alleging it failed to safeguard customers’ and employees’ personal information from hackers.

Plaintiff Susan Owen-Brooks says she was notified last month about a Dish Network data breach in which the personal information of the satellite television provider’s customers and employees was compromised.

News reports indicated the Dish Network data breach was actually a ransomware attack from a Russian ransomware gang called Black Basta, Owens-Brooks says, which accessed the data on Feb. 23.

The hackers reportedly accessed customer and employee names, birthdates, addresses, email addresses, Social Security numbers, driver’s license numbers, credit card or account information and other personally identifiable information (PII).

With this PII, the Dish Network class action notes, cybercriminals are able to commit a number of crimes in the victims’ names, such as opening new financial accounts, taking out loans, obtaining medical services, obtaining government benefits, filing fraudulent tax returns and giving false information to police during arrest.

Plaintiff: Dish Network data breach increases risk of identity theft, fraud

Owen-Brooks says the putative class members’ identities are at risk due to the Dish Network data breach, and seeks compensatory damages, reimbursement of out-of-pocket costs and injunctive relief on behalf of herself and the proposed class.

The Dish Network class action notes that the company’s privacy policy assures customers that it will not share PII with third parties except in specific, defined circumstances and that it takes information security seriously.

However, Owen-Brooks says Dish Network failed to comply with industry standards and left its customer and employee data vulnerable to cybercriminals. 

She notes the high market value of PII and the substantial risk of prison time for cyber theft to stress the importance of information security, and that there is high probability that the information stolen in the Dish Network data breach will be “dumped on the black market,” putting class members at increased risk of fraud and identity theft.

The Dish Network class action lawsuit asserts claims for negligence, breach of contract, breach of implied contract, unjust enrichment, and violation of the North Carolina Deceptive Trade Practices Act.

In 2021, Dish Network agreed to a settlement over claims it made telemarketing calls to phone numbers listed on the National Do Not Call Registry in violation of the Telephone Consumer Protection Act.

    Almost same identical thing I’m going through right now.
    All the accounts I have are now compromised and I am unable to do autopay anymore because of debit cards having to be cancelled, it’s been very traumatic!

    Our service with Dish froze up our connection couldn’t pay the bill, still had to pay for the month we didn’t have service. Couldn’t get ahold of anyone from DISH to fix the problem.

    Please add me to the Class Action! Was a loyal customer to Dish for 28 YEARS. The data breach happened and was unable to log into my account and services were cut off and was charged FOUR months of subscriptions even though service was cut and was unable to access my account online and could not trust the phone number to call due to the cyber attack. Finally when the attack was over, they agreed to remove the charges if I paid for the current month which was $150. Little did I know, my next month was 2 days later so was charged $300. Never signed back up for AutoPay due to the lack of trust. Finally decided to cancel because i owed $200 and would pay $100 here and there to turn the service back on. Owed $260 and they told me if I put my account on “hold” then I will only have to pay $183 and everything else will be squared away. I paid the $183, they transferred me to a dept to put my acct on hold and after waiting 20
    Min on hold, the person didn’t know how to put my account on hold and said my service has been and is currently cancelled. He asked if I wanted to reinstate. I said no, and we hung up. Now I’m getting emails that I owe $250!!! This is the biggest scam, piece of shit company I’ve ever experienced. Their boxes don’t even connect to my WiFi and never have been able to. I have SO many other horrible experiences. Please sign me up!!
