Dell data breach class action lawsuit overview:

Dell Inc. bears responsibility for a data breach that compromised the personal information of 49 million customers earlier this month, a new class action lawsuit claims.
Plaintiff John Lattimore’s class action lawsuit claims Dell had “impermissibly inadequate” data security in place, prior to the data breach on or about May 9.
“As evidenced by the Data Breach, (Dell) inadequately maintained its network, platform, software—rendering these easy prey for cybercriminals,” the Dell data breach class action says.
The class action lawsuit argues Dell also failed to provide timely notice about the data breach to those affected by the incident, depriving them of the opportunity to “take speedy measures to protect themselves and mitigate harm.”
Lattimore wants to represent a nationwide class of persons or entities who had their personally identifying information affected by the data breach suffered by Dell and its affiliated entities on or about May 9, 2024.
Class action claims Dell knew prior to incident that it was at risk of suffering data breach
Lattimore argues Dell knew about the risk of suffering a data breach prior to the incident, yet failed to take the appropriate steps to protect its customers’ personal data from being compromised.
“Defendant’s negligence in safeguarding Plaintiff’s and Class Members’ PII was exacerbated by repeated warnings and alerts directed to protecting and securing sensitive data, as evidenced by the trending data breach attacks in recent years,” the Dell class action says.
Lattimore claims Dell is guilty of negligence, breach of contract and implied contract, and unjust enrichment. The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of compensatory and punitive damages for himself and all class members.
Dell alerted its customers about the data breach earlier this month. The company attributed the incident to the breach of a company portal containing customer purchase information.
