- Five users of BetMGM, the betting division of MGM Resorts, filed four similar lawsuits in New Jersey in late 2022 and early 2023, citing invasion of privacy, breach of contract and negligence for failure to protect personal information.
- U.S. District Judge Julien Xavier Neals wrote in his order April 3 that the consolidation allowed BetMGM to avoid addressing each lawsuit individually.
- One of the plaintiff’s attorneys requested the consolidation.

BetMGM allowed a data breach that exposed the sensitive personal information of more than 1.5 million of its customers, a new class action lawsuit alleges, joining two previous lawsuits filed in the wake of the 2022 breach.
Plaintiff Anthony Grippa filed the class action complaint against BetMGM — the betting division of MGM — on Jan. 26 in a New Jersey federal court, alleging negligence and violations of warranty and privacy laws.
It is the third lawsuit of its kind, after BetMGM announced the data breach Dec. 21, saying a hacker obtained certain BetMGM patron records in an unauthorized manner.
According to Grippa’s complaint, BetMGM’s poor security resulted in a breach of the company’s network that allowed a third party to access his sensitive personal information.
He alleges a third party accessed BetMGM’s network in May 2022 and stole personally identifiable information, including names, email and postal addresses, phone numbers and birthdates, of every customer who placed a casino wager using BetMGM’s website.
The company learned of the violation Nov. 28 and only advised affected customers Dec. 21, 2022, the lawsuit says.
Late notice of data breach caused issues for customers, lawsuit alleges
When BetMGM contacted customers three weeks after it learned of the breach, it assured them their passwords and account funds were not accessed, the lawsuit states.
However, earlier that same day, someone posted to a cybercrime forum that they had breached BetMGM’s cyber security, and that data from that breach was for sale, the complaint states.
“Defendant’s delayed response adversely affected plaintiff and other class members as they could have undertaken proactive measures to secure their [personal information],” Grippa says.
“Instead, defendant sat on this important information to the detriment of plaintiff and the class, until defendant’s hand was forced by the cybercrime posting.”
Grippa says he and other customers have been harmed by having their personal information put at risk of theft and identity fraud. He is looking to represent anyone else in the United States whose data was compromised in the data breach.
Grippa is suing for negligence, breach of contract and breach of fiduciary duty and seeks damages, fees, costs and a jury trial. The lawsuit also seeks to force BetMGM to address the vulnerabilities in its system and to delete all personal information it can’t justify storing.

yeah, I also had the conference but I haven’t heard anything since
I was contacted by the lawyer and had a conference call with the lawyer and a mgm representative where they offered me a settlement abd i declined. That was months ago and i haven’t heard anything since.
I did the same thing and declined. Lawyer explained that by declining it could take months until this is taken care of.

I received the email that my information was hacked. This is one of 3 places that this has happened to me.
McAfee security shows my information has been a part of 19 breaches. 0 before BetMGM decided to withhold the fact that our information had been exposed for at least a month. Then lied that our info and passwords were safe. This is getting a bit ridiculous.
Please add me. I have gotten several emails stating my information was breached and to report fraud.
