Cavender’s data breach class action:

  • Who: Plaintiff Alexis Sanchez alleges Western Clothing Store Cavender’s did not protect sensitive employee data.
  • Why: Cybercriminals infiltrated Cavender’s computer systems in April 2022, compromising employees’ personal and health information.
  • Where: The class action lawsuit was filed in federal court in Texas.

Plaintiff Alexis Sanchez brought a federal class action lawsuit against Cavender’s, a popular Western retail store, alleging the chain insufficiently protected its computer systems from cybercriminals.

The Cavender’s class action claims the retailer failed to “adequately train its employees on cybersecurity and failed to maintain reasonable security safeguards or protocols.” 

Threat agents hacked the retailer’s data on April 27, 2022, and Cavender’s discovered the breach in mid-May, the lawsuit states. However, it claims Cavender’s did not notify those exposed in the breach until nearly three months later. 

The Cavender’s data breach class action claims that names, addresses, Social Security numbers, financial account numbers, credit card numbers, debit card numbers, medical information, health insurance information and the names of employees’ children were compromised during the breach.

“Because of the defendant’s data breach, the sensitive private information of plaintiff and class members was placed into the hands of sophisticated cybercriminals — inflicting numerous injuries and significant damages” to class members,” the lawsuit states.

Cavender’s class action claims fake business started in plaintiff’s name as result of breach

Sanchez allegesthat because of the breach, the Internal Revenue Service notified him that some started a business in his name and attempted to change his official address. Sanchez claims he incurred out-of-pocket costs to “prevent, detect and recover from” identity theft and fraud. He also experienced a delay in receipt of his tax refund.

The Cavender’s data breach “resulted from a combination of inadequacies,” according to the complaint, which gives nine specific examples. It asserts that Cavender’s violated the Federal Trade Commission Act as well as the Health Insurance Portability and Accountability Act, enacted in 1996 to, in part, protect the privacy of health information.

Sanchez seeks to represent anyone who received a breach notice dated July 20, 2022. The lawsuit claims more than 21,000 people were exposed in Texas alone.

Cavender’s is not alone in dealing with a security breach. The U.S. Government Accountability Office reported that people reported 32,000 security incidents to the Department of Homeland Security in FY 2021. And just days before the Cavender’s class action complaint, TransUnion announced a breach of customers’ personal information.
