St. Francis College agreed to a class action lawsuit settlement to resolve claims surrounding a 2018 data breach.Â
The settlement benefits individuals who received a data breach notification from St. Francis regarding a data security incident in November and December 2018.
Between November and December 2018, a number of employees for St. Francis College were the victims of payroll fraud, according to a data breach notification. As a result, employee email accounts were allegedly compromised and led to unauthorized access to individuals’ names, addresses, Social Security numbers, financial account numbers and private health data.
Affected individuals quickly took legal action against St. Francis College, arguing the institution had a duty to protect their information from cyber criminals but failed to do so through negligence. The students and employees in the class action lawsuit aimed to hold St. Francis College for fraudulent charges, identity theft and other damages resulting from the data breach.
St. Francis College hasn’t admitted any wrongdoing but agreed to a class action settlement to resolve these allegations.
Class members who experienced monetary losses as a result of the data breach can receive compensation from the settlement.Â
Class members can claim up to $150 in out-of-pocket expenses, including identity theft, fraud, bank fees, credit expenses, communication fees and more. The settlement also allows for up to four hours of lost time at a rate of $20 per hour, subject to the $150 cap for expenses.
All class members are eligible for three years of identity theft protection service through Pango’s Identity Defense Complete. These services include one-bureau monitoring, dark web monitoring, monthly credit scores, credit report access, high-risk transaction monitoring, authentication alerts and $1 million in identity theft insurance.
St. Francis has agreed to make security improvements such as additional employee training, enhanced security measures and improved policies to better protect information. These measures provide non-monetary relief to affected consumers in the wake of the data breach.
The deadline for exclusion and objection is Jan. 22, 2023.Â
The final approval hearing in the St. Francis College data breach settlement is scheduled for Feb. 16, 2023.
Class members also have the option to update their contact information on the settlement website using the notice ID and PIN mailed to them with their settlement notice.
In order to receive settlement benefits, class members must submit a valid claim form by Feb. 21, 2023.Â
