A $4.3 million settlement agreement over an alleged Sonic data breach will end a class action lawsuit against the fast food company.
If you used a credit or debit card at one of 325 Sonic restaurants between April 7, 2017 and Oct. 28, 2017, you could get cash from the Sonic data breach class action settlement. A list of affected Sonic locations is available on the settlement website.
Several Sonic customers lodged class action lawsuits against the drive-in restaurant alleging that their financial and personal information was exposed in a 2017 data breach. Reportedly, certain locations of the fast food drive-in were hit by a malware attack that siphoned the personal and financial information of customers.
The Sonic data breach was made possible by insufficient security measures, claimed the class action lawsuits. Complicating matters, Sonic allegedly failed to notify affected customers in a timely fashion, further exposing them to fraud and identity theft.
One consumer alleged in her class action lawsuit that she was hit with nearly $70 in fraudulent charges as a result of the Sonic data breach. As a result, she claims to have spent hours with her bank and was unable to access her account or use her debit card while her bank investigated.
Another couple claimed in their Sonic data breach class action lawsuit that the restaurant failed to adequate protect its customers’ personal and financial information, particularly in light of recent similar data breaches at competing businesses.
Under the terms of the Sonic data breach class action settlement, those who used their debit or credit cards at an affected location can claim $10. Those who suffered fraudulent charges because of the breach can claim $40.
Class Members must submit a Claim Form either online or via mail with their name and address by April 19, 2019. The location of the Sonic will need to be provided.
Additionally, Class Members seeking to claim fraudulent charges will need to submit proof of the charge.
Class Members have until April 19, 2019 to object or exclude themselves from the Sonic data breach class action settlement.
UPDATE: On Nov. 14, 2019, Top Class Actions viewers started receiving checks in the mail worth $129.76 from the Sonic data breach settlement. Congratulations to everyone who filed a valid claim and got PAID!
Who’s Eligible
Class Members include U.S. residents who “made a purchase using a credit or debit card at one of the 325 impacted Sonic Drive-In locations from April 7, 2017 through October 28, 2017.”

Proof of Purchase
The location of the Sonic where the Class Member made the purchase will need to be provided. Class Members seeking to make a claim for fraudulent charges will need to provide the last four digits of the card affected by the charge and should retain and provide proof, such as bank statements, receipts, or other documents.
